A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Chief Minister’s Department (CMD) request for a change in use of carry forwards currently allocated to Financial Services and Public Sector Reform to be used toward the costs, in 2015, of the lead of the Task Force – Early Intervention for Families.

Decision(s): 

The Minister approved the request of CMD to change the use of a carry forwards currently allocated to Financial Services and Public Sector Reform in the combined amount of £68,650 to be used toward the costs, in 2015, of the lead of the Task Force – Early Intervention for Families.

Reason(s) for Decision: 

Article 18(3A) of the Public Finances (Jersey) Law 2005 states the Minister may approve the withdrawal from the consolidated fund, after the end of the relevant financial year, of all or part of the amount appropriated by a revenue head of expenditure.

Resource Implications: 

Other than the change of use there are no resource implications.

Action required: 

Head of Decision Support to inform the Finance Manager - Corporate Group and the Financial Performance Reporting Manager that this decision has been approved.

Change of use for Carry Forward budget

 

  1. Purpose of Report

 

To enable the Minister for Treasury and Resources (T&R) to approve the Chief Minister’s Department (CMD) request for a change of use of carry forwards currently allocated to Financial Services and Public Sector Reform in the combined amount of £68,650 to be used toward the costs, in 2015, of the lead of the Task Force – Early Intervention for Families.

 

  1. Background to this Decision

 

A cross-departmental (ESC, H&SS and CMD) non-permanent task force has been established to help ensure the best outcomes for children and young people by working together.  This will include a focus on families who are expecting children, or have children aged 2 or below, and who need help to develop parenting skills (i.e. 1001 Critical Days), and those families who are dealing with complex problems, such as domestic violence, alcohol and substance misuse and/or offending behaviours, which impact on the ability of their children to thrive, or be safe, in the home environment.

 

There are no additional FTE implications. The lead of this task force is Dr Helen Miles who is transferring from States of Jersey Police from 05 May 2015 to the Home Affairs Executive. The Task Force will work across departments and with a number of stakeholders including Brighter Futures and the NSPCC among others.  Home Affairs will invoice CMD for £68,650 in 2015.

 

It is requested carry forward amounts originally allocated to Financial Services and Public Sector Reform in the amounts of £61,058 and £7,592 respectively be used to fund in 2015 from May, the cost of the lead of the Task Force – Early Intervention for Families as detailed in the table below;
