Public Finances (Amendment No. 4) (Jersey) Law 201-

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: The approval of the Draft Public Finances (Amendment No. 4 (Jersey) Law, which proposes changes to the following areas of the Public Finances (Jersey) Law  2005:

 

  • Establishment of the States Insurance Fund;
  • Medium Term Financial Plan and Heads of Expenditure;
  • Role and Remit of the Treasurer;
  • Extending the Accounting Officer role;
  • Formalisation of the Fiscal Policy Panel; and
  • Miscellaneous - Law to be amended by Regulation and changes to Special Funds.

 

Decision(s):  The Minister decided to lodge ‘au Greffe’ the Public Finances (Amendment No. 4) (Jersey) Law.

Reason(s) for Decision:  To enable the Public Finances (Amendment No. 4)(Jersey) Law to be lodged ‘au Greffe’ with a request for debate in the States sitting at the earliest opportunity.

Resource Implications:  There are no financial or manpower implications associated with this decision.  

Action required:  Forward the Public Finances (Amendment No. 4) (Jersey) Law and associated report to the Greffier of the States and request that the projet be lodged ‘au Greffe’ for consideration by the States at the earliest opportunity.

Public Finances (Amendment No. 4)(Jersey) Law 201-

 

1. Purpose of Report

 

The purpose of this report is to gain the Minister for Treasury and Resources approval to Public Finances  (Amendment No. 4) (Jersey) Law 201- which covers changes to the following areas of the Public Finances (Jersey) Law 2005:

 

  • Part 2 - Formal Establishment of the States Insurance fund
  • Part 3 - MTFP and variations to heads of expenditure;
  • Part 4 - Role and Remit of the Treasurer;
  • Part 4 - Extension of the Accounting Officer role;
  • Part 5 - Formal establishment of the Fiscal Policy Panel; and
  • Part 6 - Future amendments to Parts 2 and 3 of the Law to be made by Regulation

 

to enable formal lodging “au Greffe” for consideration by the States at the earliest opportunity.

 

2. Proposed Law Amendments

 

2.1 The Draft amending legislation and covering report is attached.

 

2.2 The Amending legislation has been considered by Council of Ministers and has been the subject of both a private and public Corporate Services Scrutiny Panel meeting. 

 

3. Recommendation

 

The Minister for Treasury and Resources is asked to approve the attached Draft Public Finances (Amendment No. 4) (Jersey) Law 201- and agree that it can be lodged “au Greffe” for consideration by the States at the earliest opportunity.
