A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Boarding Out Residential Care for the Over 65’s

Purpose of the Report

The Health & Social Services Minister is asked to authorise the transfer of budget to Social Security, in relation to boarding out residential care placements for the over 65’s.

That the Finance Director be requested to action the budget transfer.

Background

On 28th January 2008, with the introduction of Income Support, Social Security Department took over responsibility for funding the boarding out element of residential placements, the Health and Complex Social Care needs (traditionally erroneously termed “nursing care”) remaining the responsibility of Health & Social Services.

It has been agreed between the finance directors of the respective departments that budget for 60 patients be transferred to Social Security, amounting to £965,650 as those at 28th January 2008.

It has been further agreed between the Finance Directors of both departments that with effect from 1st July, 2009 Health & Social Services will transfer 3 FTE and funding for the bottom of a grade 6 to cover all of the residential care administration tasks. These 3 FTE are in effect being given in advance as it also includes the expected future budget transfers associated with the residential aspects of Nursing Home beds and the under 65 beds where transfers may need to occur (subject to Ministerial Decision).

Interim arrangements to date

Health & Social Services continued to administer the boarding out residential care placements for the over 65’s on behalf of Social Security up to 30th April 2009 in order that the Social Security Department could get appropriate systems and procedures in place in order to assume the administration of this budget.

As a result of this interim arrangement the net budget for boarding out residential care placements to 30th April 2009 (amounting to £285,216), has been deducted from the total budget for 2009.

With effect from 1st May 2009, Social Security has assumed administration and control of the boarding out budget.

Recommendation

That the Health & Social Services Minister authorises the budget transfer to Social Security, as indicated above and requests that the Treasury & Resources department actions the transfer.
