A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision (S):

The Assistant Minister,

1. approved the immediate sale of Belleville La Rue du Crocquet St Aubin JE3 8BZ to Mr Douglas Jeffrey MacCabe and Mrs Carol ann MacCabe (nee Grant) for the sum of £575,000.00 arrived at in accordance with HD 22 ‘Valuation Policy for Sales’;

2.  resolved to seek the approval of the Treasury and Resources Minister to the disposal on the open market, rather than by way of shared equity, under the provisions of States Standing Order 168.

REPORT TO THE HOUSING MINISTER  

BELLEVILLE AGREEMENT OF SALE  

On 17th July 2007 the States approved P6.2007 The Social Housing Property Plan 2007 – 2016.  This provided approval for the sale on the open market of a number of non-core properties which were owned by the Public of the Island and were in the stewardship of the Housing Department. Belleville, St Aubin was included on the list of proposed sales which was ultimately agreed at Line 2. 

The property had been valued in accordance with the approved valuation policy HD22 Valuation Policy for Sales, originally approved by the Housing Minister under MD-H-2007-0057.  The valuation set is therefore valid until 28 May 2010. 

An offer to purchase the said property Belleville has been received from Mr Douglas Jeffrey MacCabe and Carol Ann MacCabe (nee Grant). This will be a cash purchase, there is no onward chain. 

Recommendations  

That the Minister,  

1. Approve the sale of Belleville for the sum of £575,000 to Mr Douglas Jeffery MacCabe and Mrs Carol Ann MacCabe (nee Grant).  

2. request that the Treasury & Resources Minister agree to the transaction under Standing Order 168 (2) (a) and that the following notification to the States in accordance with Standing Order 68 (3) to authorise the Greffier and Attorney General to pass the necessary contracts on behalf of the Public;   

3. That in accordance with the States approval of P6.2007 the resultant funds are to be credited to HYR000.121010
