Draft Sea Fisheries (Miscellaneous Provisions) (Amendment No. 4) (Jersey) Regulations 200-.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Purpose of the Report

To approve the draft legislation and authorise that it be transmitted to the UK for scrutiny at both official and technical officer level.

Background

The Environment and Public Services Committee approved the drafting of the Sea Fisheries (Miscellaneous Provisions) (Amendment No.4) (Jersey) Regulations at their last meeting on 17th November 2006.

Jersey and French commercial fishermen have adopted systems to restrict the number of pots used by them in the Bay of Granville to catch crabs and lobsters, but those systems depend on “tags” being fitted to all such pots. France has already introduced legislation to reinforce this requirement for the French part of the area and Jersey fishermen are currently required by the conditions of their fishing licences to fit the tags in the Jersey part of the area. Currently there are no enforceable regulations requiring that French fishermen working pots in the Jersey part of the area fit tags to their pots, although both French fishermen and administrators have agreed to such regulations.

The draft regulations create a requirement for all commercial fishermen working shellfish pots to fit the tags and make provision for the issue of “lost pot tags” where tags have been inadvertently lost. The Minister may also issue “Permits” in circumstances where it is impractical for a fisherman to comply with the tag requirement (it is intended that Fishery officers will also have this authority under delegated powers).

There are no financial or manpower implications as the draft regulations simply replace fishing licence conditions for the local commercial fishermen.

Discussion

In accordance with the Jersey/UK Fisheries management Agreement and the Sea Fisheries (Jersey) Law 1994, Secretary of State approval is required before the legislation can be approved by the States Assembly. To speed up this process, a procedure has been established whereby a set of the draft regulations is normally sent at the same time to the officer at DEFRA having responsibility for Jersey/UK liaison on fisheries matters.

Recommendation

It is recommended that the draft regulations are approved for onward transmission by the Crown Officers for Secretary of State approval and that the Senior Fisheries Inspector is authorised to send a further copy to DEFRA.
