Road Traffic (No. 61) (Jersey) Regulations 201-

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

DRAFT ROAD TRAFFIC (NO 61) (JERSEY) REGULATIONS 2014

Purpose of the Report

To introduce new Regulations which will prohibit anyone carrying out a motor trader or car sales business from using public parking facilities to store their trading stock of vehicles in public car parks or a public road.

Background

A problem has been highlighted where a motor trader has been using car parks administered by Transport and Technical Services and also on street parking areas in St Martin to store vehicles they have for sale. The matter has been raised in the public domain through the local media.

After discussions with the Legal Advisors at Police Headquarters there are no current offences which will adequately deal with this problem in the Road Traffic (Public Parking Places) (Jersey) Order 2006, the Policing of Roads (Jersey) Regulations 1959 or any of the 12 Parish Road Traffic Orders.

The Law Draftsman has recommended changing the Road Traffic (Jersey) Law 1956 by Regulation to introduce the new offences as previously approved by the Minister for Transport and Technical Services under Ministerial Decision MD-T-2014-0064 on 04 July 2014 rather than making 13 Amendments to various Orders as these would still involve a change by Regulation to the primary legislation.

Discussion

Officers support the introduction of the new Regulations above. Policing will be carried out by Transport and Technical Services Parking Control Section and the 12 Parishes Honorary Police as appropriate.

Recommendations

The Minister is recommended to approve the Draft Road Traffic (No 61) (Jersey) Regulations 2014.

Reason(s) for Decision

To enable the addition of new offences prohibiting anyone from using a designated parking place or a public road to park vehicles exposed, offered or advertised for sale or hire in the course of a motor trading business.

Resource implication

There are no financial or manpower implications arising from these Regulations.

Action Required

Officers to request the Greffier of the States to arrange for the Draft Regulations to be lodged ‘au Greffe’ for consideration by the States on 22 September 2014 and once resolved to proceed to signature.
