Road Traffic (Speed Limits) (Jersey) Order 2003: Amendments: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister approved the proposal to extend the 30mph speed limit on La Rue de Sergenté, St Brelade, apply a 20 mph speed limit to La Rue du Patier and Chasse Brunet in St Saviour, and to La Rue des Canons in St Helier and to extend the 15 mph limit on La Rue de L’Eglise in St Lawrence (North to Revenue House).

 

Reason(s) for Decision: To amend the Road Traffic (Speed Limits) (Jersey) Order 2003 to lower speed limits on certain roads where the proposal has the support of the Connétable of the Parish and is consistent with current Policy.

 

Resource Implications: Law Drafting time will be required as well as approximately £500 from the Department’s revenue budgets for the installation of the required signage.  Each Parish will be required to fund the signage where signs are erected on Parish by-roads.

 

Action required: Manager – Transport Policy to instruct the Law Draftsman to prepare an Amendment to the Road Traffic (Speed Limits) (Jersey) Order 2003 for subsequent submission to the Minister.

AMENDMENTS TO THE ROAD TRAFFIC (SPEED LIMITS) (JERSEY) ORDER 2003

 

 

Purpose of the Report

 

To amend the Road Traffic (Speed Limits) (Jersey) Order 2003

 

 

Background

 

There are a number of outstanding requests to lower speed limits on various roads on the island. A review of these requests has been deferred following the outcome of an island wide speed limits policy consultation which the Minister proposed to undertake as part of the development of a road safety strategy.  The consultation however has been delayed as it would be inappropriate to undertake it during the period overlapping the forthcoming elections and the subsequent appointment of Ministers for the new term.  There are however certain requests which are considered non contentious and appropriate to be progressed without further delay as discussed below.

 

 

Discussion

 

St Brelade

 

Following the completion of significant housing developments on La Rue de la Sergenté, the eastern end of the road was designated a 30 mph limit in April 2014 with the limit returning to 40 mph at the western end of the built up area.  Although consistent with States policy to apply a 30 mph limit to the built up area, it has resulted in signage which could encourage motorists to increase their speed at the approach to the railway walk crossing.  It is therefore proposed to extend the 30 mph limit approximately 100m further west to a point immediately west of Le Coin / La Moye View so that the area of the railway walk crossing is covered within the 30 mph zone.  The Connétable is supportive of this alteration.  

 

St Helier

 

The Parish Roads Committee has requested a 20mph limit on La Rue des Canons and also propose to install three speed humps.  The two measures are complimentary.  The road is a residential by-road and not appropriate for use as a through route.  A 20 mph limit is therefore considered appropriate.

 

St Lawrence

 

The Connétable and Parish Roads Committee have requested that the “Green lane” 15mph limit on La Route de L’Eglise be extended to cover the remaining section north to Revenue House. The road is a quiet Parish by-road with a rural character and the proposal would be a logical extension to the green lane network.

St Saviour

 

The Connétable has requested that La Chasse Brunet and La Rue de Patier be designated a 20 mph limit.  Both are Parish by-roads with a high residential use, are used as walking routes to the various schools in the area, have few footpaths and are unsuitable as through routes.  A 20 mph speed limit would therefore be appropriate. 

    

 

Conclusion

 

Although a public consultation on speed limit policy is proposed, the above proposals are considered non contentious and appropriate to be progressed without further delay.

 

 

Recommendation

 

The Minister is recommended to approve the above proposals and  to request the Department to prepare law drafting instructions to enable the Law Draftsman to prepare an Amendment to the Road Traffic (Speed Limits) (Jersey) Order 2003.
