Pomme D'Or Farm Estate: Approval of Refurbishment Proposals

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Assistant Minister:

 

(a) rescinded Ministerial Decision MD-PH-2011-0075, and

 

(b)  approved, as recommended by Jersey Property Holdings (JPH), the Housing Department’s refurbishment proposals for the Pomme D’Or Farm Estate, St Helier as set out in the report accompanying the Housing Minister’s decision MD-H-2011-0063.

 

Reason(s) for Decision:

MD-PH-2011-0075 is rescinded as it contained a technical drafting error.

The Minister approved under Standing Order 168 (1) (d) the above land transaction.

 

Resource Implications:

There are no financial implications in respect of this decision other than those detailed in the report of the Housing Department attached as Appendix A to the accompanying report.

 

Action required:

The Director of Jersey Property Holdings is to inform the Housing Department of the approval in order that the refurbishment project may proceed.

Property Transaction for Ministerial Decision - Minister for Treasury and Resources

 

SUBJECT Refurbishment of Pomme D’Or Farm Estate

Purpose

 

In accordance with Standing Order 168 (1) (d) and 168(2), the Assistant Minister is asked to approve the Housing Department’s refurbishment proposals for Pomme D’Or Farm Estate, St Helier.

 

Background

 

The proposed refurbishment comprises a package of improvement works as set out in the report to the Housing Minister dated 25 May 2011, accompanying ministerial decision MD-H-2011-0063, an extract of which is attached as Appendix A to this report.

 

The project will refurbish 86 social housing properties in the administration of the Housing Department on the Pomme D’Or Farm Estate, St Helier. Refurbishment will take place with tenants in situ. The works include the conversion of 17 bed-sit units into one bed flats. The scheme also provides enhancements to the public realm in the form of improved parking and arrangements of external space.

 

Refurbishment of the estate is considered to be the best method of extending the life of the units. The estate does not lend itself to demolition and redevelopment as there would be limited, if any, net gain in density.

 

 

Current Situation

 

The Housing Department wishes to progress the procurement of the project and requires the approval of the Minister for Treasury and Resources, as delegated to the Assistant Minister, under SO168.

 

The project has full planning and bye-law permission.

 

A funding advance of £3.25 million from the Treasury and Resources contingency capital head of expenditure has been agreed to meet the costs of the project. The £3.25 million funding will be returned to the Treasury and Resources Department by the Housing Department as sales receipts improve. MD-TR-2011-0065 refers.

 

 


Conclusion

 

The proposed refurbishment of the Pomme D’Or Farm Estate is an appropriate way forward to regenerate the estate. The Housing Department has followed the methodology set out in Financial Direction 5.6 (The Control of Capital Expenditure) and there are no overarching property issues that detract from the proposed scheme.

 

 

Recommendation

 

The Assistant Minister is recommended to approve the Housing Department’s refurbishment proposals for of the Pomme D’Or Farm Estate, St Helier as set out in Appendix A to this report.
