Historic Child Abuse: Committee of Inquiry: Directions of the Minister for Treasury and Resources

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Report on the Minister for Treasury and Resources Directions on the Committee of Inquiry into Historical Child Abuse.

Decision(s):

The Minister approved the report detailing his directions under Standing Order 150 on the Committee of Inquiry into Historical Child Abuse and requested that it be presented to the States.

Reason(s) for Decision:

Under Standing Order 150 the Minister for Treasury and Resources is required to give directions as to:-

(a)   The remuneration (if any) of a member of a committee of inquiry;

(b)   The expenses that a committee of inquiry may incur; and

(c)    How such remuneration and expenses are to be funded.

Resource Implications:

The estimated cost of £6,000,000 for the Inquiry will be funded from Central Contingency allocation.

Action required:

Business Manager to request the Greffier of the States to arrange for the attached Report on Committee of Inquiry into Historical Child Abuse to be presented to the States at the earliest opportunity.

Committee of Inquiry: Historical Child Abuse (P.118/2012)

 

 

The Minister for Treasury and Resources may, under Standing Order 150 give directions as to:-

 

(a)   The remuneration (if any) of a member of a committee of inquiry;

(b)   the expenses that a committee of inquiry may incur; and

(c)   how such remuneration and expenses are to be funded.

 

 

The Minister for Treasury and Resources, on 4th March 2013 presented to the States his comments on P.118/2012. These identified an estimated cost of £6 million for the Inquiry which was to be funded from the Central Contingency.

 

Now that the Chairman and Panel have been appointed and their approach to the conduct of the Inquiry has been confirmed, the Minister for Treasury and Resources confirms that the sum to be made available for the Inquiry and the source of that funding are as set out in those comments onP.118/2012.
