Budget Transfers between Social Security Department and Housing Department following the Introduction of Income Support

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:

To agree budget transfers between the Social Security Department and Housing Department following the introduction of Income Support.

 

Decision(s):

The Minister approved the following:

1. The budget transfer in perpetuity of £320k from Social Security to Housing effective from 2008.

2. The one-off transfer from Social Security to Housing of £1,862,464.30 of costs relating to the  

    Rent Abatement and Rent Rebate Schemes.

 

Reason(s) for Decision:

To ensure the cash limits of Social Security and Housing are accurate following the introduction of Income Support. It was noted that the £320k was included as part of the 2009 States of Jersey Business Plan for both Departments.

 

Resource Implications:

Financial: Social Security Cash Limit to decrease by £320k in perpetuity noting that this has been

                  adjusted in the Department’s Business Plan for 2009.

REPORT TO THE MINISTER FOR SOCIAL SECURITY

 

Changes Required Following the Introduction of Income Support

 

 

Purpose of the Report

To request the approval for the following actions:

 

  1. The budget transfer in perpetuity of £320K from Social Security to Housing effective from 2008.
  2. The transfer from Social Security to Housing of £1,862,464.30 of costs relating to the Rent Abatement and Rent Rebate Schemes.

 

The need for these actions has become apparent now that Income Support is in place and functioning.

 

 

Budget Transfer in Perpetuity

It is necessary that Social Security transfers £320K in perpetuity effective from 2008 to Housing in order to permanently re-adjust the base cash limits of each department following the introduction of Income Support and the transfer of the subsidies budget.

 

 

Transfer of Costs Relating to the Rent Abatement and Rent Rebate Schemes

Following the introduction of Income Support on 28th January 2008, the rent rebate and rent abatement schemes closed to all claims on 31st March 2008. The Housing Department incurred costs of £1,862,464.30 relating to these schemes during the first Quarter but the budget for these costs sits with Social Security. As such it is recommended that these costs are transferred to Housing.

 

 

Recommendation

The Minister is recommended to approve the following:

 

  1. The budget transfer in perpetuity of £320K from Social Security to Housing effective from 2008.
  2. The transfer from Social Security to Housing of £1,862,464.30 of costs relating to the Rent Abatement and Rent Rebate Schemes.
