Register for Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey: Eden Grove Farm, La Rue des Bessieres, St. Lawrence.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Planning and Environment determined to Register as a Building of Local Interest Eden Grove Farm, La Rue des Bessieres, St Lawrence for its particular local interest.

Reason(s) for Decision:

  1. The particular interest of Eden Grove Farm, La Rue des Bessieres, St. Lawrence relative to the published criteria for selection, justifies its inclusion on the List of as a Building of Local Interest in accordance with the provisions and purposes of the Planning and Building (Jersey) Law 2002 and; it accords with the States Strategic Plan commitment of protecting and sympathetically managing the Island’s built heritage assets.
  2. The inclusion of buildings and places in the Register for Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey is consistent with the purposes of the Planning and Building (Jersey) Law 2002.

Purpose of the Report

To seek to confirm the Minister’s intention to Register Eden Grove Farm, La Rue des Bessieres, St Lawrence as a Building of Local Interest 

Background

The Minister previously considered a report on the matter prepared by Jersey Heritage dated 1st October 2008 and determined that this building and place was of sufficient interest to warrant its Registration as Building of Local Interest.. A notice of Minster’s intent to add this site to the Register was served on the owner of the property on 7th November 2008 in order to provide an opportunity for representations to be made. 

The time permitted for representations to be received has now lapsed and no representations have been received. 

Discussion and recommendation

On the basis of its particular interest as assessed against the criteria for registration, and in the absence of any representations, it is recommended that the Minister for Planning and Environment adds Eden Grove Farm, La Rue des Bessieres, St Lawrence to the Register as a Building of Local Interest.
