Island Plan 2011: Revised Draft Revision

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

Having considered those amendments from States Members and the public response to them, where they raise matters that are new, the Minister for Planning and Environment:

  1. resolved to publish his initial response to the amendments made, as set out in the schedule;
  2. authorised officers to prepare his own amendments to amendments, where relevant, as set out in the schedule, for further consideration and endorsement; and
  3. further requested officers to prepare a separate amendment to ensure that the definition of States-owned land embraced that land to be transferred to Andium Homes Limited under the auspices of P.63/2013 – the Draft Social Housing (Transfer)(Jersey) Law 201-, in so far as it relates to the delivery of the Minister’s housing strategy, as set out in his proposed revision to the 2011 Island Plan.

Reason(s) for decision:

  1. The Minister is required to prepare and lodge a revised draft revision of the 2011 Island Plan for consideration and debate in the States having had careful regard to all representations made in relation to the initial draft revised Island Plan 2011. The Minister has sought to extend this consideration to those amendments which raise new matters not previously considered, and to expose them to public scrutiny and comment in advance of a further Examination in Public prior to the States debate on the matter.
  2. The Minister wishes to ensure that the housing strategy set out in the proposed revision to the Plan remains deliverable.


Sustainability appraisal:

Environmental implications: The Minister’s comments have addressed the environmental implications of the proposed amendments.

Economic implications: The Minister’s comments have addressed the economic implications of the proposed amendments. Where the Minister is proposing further amendment to the Plan, he is being cognisant of economic concerns that have been expressed and will seek to liaise with, in particular, the Economic Development Department in relation to them.

Social implications: The Minister’s comments have addressed the social implications of the proposed amendments.

The Minister’s proposed amendment to the definition of States-owned land seeks to ensure that the social objective of meeting the Island’s need for affordable homes can be delivered by the proposed changes to the Plan.

Legal implications: The Minister’s decision is made in accordance with Article 20 of the Planning and Building (Island Plan)(Jersey) Order 2009 and Article 3 of the Planning and Building (Jersey) Law 2002;

Resource implications: There are no resource implications arising from this decision that are not accounted for within the resources available to the Department of the Environment.

Action required:

  1. publish the Minister’s initial response to the amendments made; and
  2. prepare amendments, as set out in the schedule, for further consideration by the Minister, with liaison with the relevant stakeholders as necessary; and
  3. prepare an amendment to change the definition of States-owned land, as set out above.
