Grainville Phase 3 - drawings.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

In accordance with paragraph 1 (d) of Standing Order 168, the Assistant Minister, under delegated authority, approved the drawings numbered 1875L/201-3, 204(A), 205(A), 206-211, 216-221, 229-230, 232, 234-6, 240-241; 10497/15-16; AAC-GS-00(2), AAC-GS-01(2) and document: 1875L / Design Strategy Statement & Building Byelaws Checklist (August 2005) all showing the proposed redevelopment of Grainville School Phase 3.

Reason(s) for decision:

The drawings have planning and bye-law approval (Permit B/2005/0856 refers) and were approved by the Minister for Education, Sport and Culture on 30/01/2006.

The drawings reflect the use for which funds were allocated in the 2006 capital budget and the pre-tender estimate indicates that the project, as designed, can be completed within the allocated budget sum plus any allowance for inflation held in the Capital Reserve. The Treasury will review the financial position once the tender process has been completed.

Property Holdings recommends approval of the drawings.

Action required:

Advise the Education, Sport and Culture Department of the outcome to enable the tendering process to continue.

Pass stamped approved drawings to the States Greffe Registry Section.
