Jersey Community Relations Trust - amended constitution.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Chief Minister decided –

  • en lieu of the Policy and Resources Committee, to approve the amended draft Constitution of the Jersey Community Relations Trust and to refer it to the Judicial Greffier in accordance with the Law;
  • to ask the elected members of the States to indicate to him if any of them is willing to be nominated as the Trustee to be appointed by the States. 

Reason(s) for Decision:

Since the Constitution of the Jersey Community Relations Trust was adopted, in January 2004, it has become necessary to make certain amendments as a consequence of the change to Ministerial government and to simplify the provisions relating to the appointment of Trustees.  

Resource Implications:

There are no resource implications for the States directly arising from this decision.

REPORT

Jersey Community Relations Trust – Amended Constitution

Background

The Jersey Community Relations Trust (JCRT) was established by the States on 20 January 2004 on a proposition of the Policy and Resources Committee, P.120/2003.

Since the Trust Constitution was adopted, it has become necessary to make certain amendments as a consequence of the change to Ministerial government and to simplify the provisions relating to the appointment of Trustees.  

Paragraph 9 of the current Constitution provides that -

“This Constitution may be altered by a resolution passed by a majority of those present and voting at a Meeting of the Committee called for that purpose, provided that no such resolution shall be considered unless a notice in writing setting out the terms of the resolution shall have been sent to every member of the Committee not less than 14 days before the date of the Meeting at which it is to be considered: PROVIDED ALWAYS that no alteration to these Rules shall be effective until approved  

(i) by the Policy and Resources Committee; and thereafter

  (ii) by the Royal Court of Jersey in accordance with the Law.”

A duly convened meeting of the Trustees was held on Monday 4 February 2008, at which the following amendments were passed by a unanimous resolution of the Trustees present.

Proposals

The Committee of Trustees has agreed –

  • The Committee of Trustees shall consist of five members appointed by existing Trustees;
  • The States of Jersey shall appoint an additional Trustee from among their members;
  • The States of Jersey shall also appoint an independent Chair;
  • All appointments shall be for a term of four years, initially commencing from 1st March 2008.

The Trustees also agreed to amend the constitution in accordance with current political responsibilities arising from the change to Ministerial government.  A draft amended constitution is attached.

Recommendation

The Chief Minister is recommended –

  • en lieu of the Policy and Resources Committee, to approve the amended draft Constitution of the Jersey Community Relations Trust and to refer it to the Judicial Greffier in accordance with the Law;
  • to ask the elected members of the States to indicate to him if any of them is willing to be nominated as the Trustee to be appointed by the States.
