Transport and Technical Services Department: Fees and charges increase for 2013

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Minister approved the increases to the Department’s fees and charges as set out in the attached schedule.

 

Reason(s) for Decision:  To enable the Department to increase its fees and charges in 2013 in line with the Anti-Inflation Strategy agreed by the States and to allow the department to achieve the Departmental income as per the 2013 States Annual Business Plan and ensure cost recovery.

 

This Ministerial Decision excludes the charges for Jersey Car Parks which will be under a separate Ministerial Decision once the third quarter RPI figure is available.

Resource Implications:  The additional income as a result of the proposed increases to fees and charges has been included within the income estimates in the Medium Term Financial Plan for 2013.  The cost of advertising increases to fees and charges in the Jersey Evening Post.

 

Action required:  The Finance Director to arrange for the Department’s fees and charges to be advertised in the Jersey Evening Post once the actual for the September RPI has been published.

 2013 DEPARTMENTAL INCREASES to Fees and Charges

 

 

  1. Purpose of Report

The Minister for Transport and Technical Services is asked to approve a request to increase the Department’s various fees and charges for 2013 (a schedule of charges is attached as Appendix A).

 

 

  1. Discussion

The majority of the proposed increases have been limited to 2.5% per annum in accordance with the States Anti-Inflation Strategy.

 

In addition, it is proposed that the following fees and charges are not increased by a straight 2.5% for the reasons detailed below.

Knackersyard

Cattle per kilo (minimum charge £10 excluding GST)

Goat/Sheep/Pig/Other per kilo (minimum charge £10 excluding GST)

As a result of roundings the price per kilo for cattle, goats, sheep, pigs and other animals excluding calves and horses will remain at 2012 prices but will be subject to a compounded increase for 2014.

Commercial Green Waste

No Increase

As a result of roundings the price per kilo for commercial green waste will remain at 2012 prices but will be subject to a compounded increase for 2014.

 

Soil Improver 40 litre bags

No Increase

Maintain at 2012 prices to encourage sales.

Composters plus Caddy (each) minimum order 10 (only sold to garden nurseries)

No Increase

Maintain at 2012 prices to enable garden nurseries to sell at £10 each to encourage sales.

Bus Charges

Remove.

These charges have been removed from the schedule as they are now set by operator from 2013 with approval from Minister for TTS.

Motor cycles (CBT)

Increased as per agreement September RPI(Y)

There is an agreement that the fee for CBT will increase each January by RPI as at the previous September. The September 2012 RPI figure will not be released until 24 October 2012.  The forecast for this figure is 2.9%.  The Minister is asked to approve this increase based on the forecast to allow time for the approval process; however the actual increase to be charged and advertised will be the actual RPI as at September 2012.

International driving permits

No Increase

Issued by the parish, retain a £10.00 flat fee.

All other Driver and Vehicle Charges

Roundings

These have been rounded to the nearest 5p to assist with cash handling.

 

The fees and charges for Jersey Car Parks have not been included as part of this Ministerial Decision but will be brought to the Minister for consideration once the third quarter RPI figure is available.

 

In accordance with Finance Direction No 4.1 Increases in States Fees and Charges, all increases to charges above 2.5% require the approval of the Minister for Treasury and Resources.   The Treasurer of the States can approve increases to States charges under his delegated powers, where those increases are non-contentious. 

 

The above fees and charges will be increased in line with the attached Appendix with effect from 01 January 2013.

 

 

  1. Recommendation

That the Minister approves increases to the fees and charges for 2013 as set out in the attached Appendix. That the Minister requests the Finance Director to arrange for the Department’s fees and charges to be advertised in the Jersey Evening Post once the actual for the September RPI has been published.
