Road Traffic (St Brelade) (Jersey) Order 1990: Amendment: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

ROAD TRAFFIC (ST BRELADE) (JERSEY) ORDER 1990 AMENDMENT

 

 

Purpose of the Report

 

To amend the Road Traffic (St Brelade) (Jersey) Order 1990 by Article 68 notice to convert all disc parking on La Neuve Route, a Department for Infrastructure (DfI) administered main road, to Paycard Parking.

 

 

Background

 

A review of the parking regime in the St Aubin area has identified the need to rationalise parking in the area. The many different and inconsistent parking rules in the area are confusing to tourists and many of the spaces available are used by motorists parking for long periods and parking and commuting into St Helier.

 

This report considers how disc parking should be removed from La Neuve Route, the main road between St Aubin Village and La Haule Hill, to be replaced with pay card parking.

 

 

Discussion

 

There are currently five different parking arrangements on La Neuve Route between St Aubin and La Haule Hill:

 

  • 20 minute limit
  • 1 hour limit
  • 12 in 24
  • No restriction

 

The 20 minute limit applies to a small area immediately outside St Aubin’s Food Hall which is appropriate and should stay as it is. The remainder of La Neuve Route should be subject to one consistent parking arrangement. A suitable arrangement would be to charge for parking between 0800 and 1700 Monday to Saturday, and to allow vehicles to stay for a maximum period of 12 hours. The parking rate should be 1 parking unit for 2 hours. This parking arrangement and charging regime will match the Department for Infrastructure administered off road car parks in the area, and DfI “out of town” car parks generally.

 

Aligning the charging and maximum period for parking with the DfI off road car parks will:

 

  • make parking less confusing for tourists
  • make parking easier to police
  • make the roll out of pay by phone easier and more straightforward
  • create a better turnover of vehicles and use of the available space for parking.  

 

 

Recommendation

 

The Minister is recommended to approve the proposal to amend the Road Traffic (St Brelade) (Jersey) Order 1990 by Article 68 notice.
