Jersey Competition Regulatory Authority: Short term appointment of Chairman

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision and reason for the decision

The Chief Minister approved the Report notifying the States that Mr Paul Masterton, Senior Independent Director of the JCRA, is to be appointed as Chairman of the Authority for a transitional period.

 

The Chief Minister intends to appoint Mr Masterton as Chairman of the JCRA under powers conferred by Article 3(1)(a) of the Competition Regulatory Authority (Jersey) Law 2001. The period of appointment is from 1 January 2020 and will continue, at the latest, until 30 June 2020 or, if earlier, until the date on which a permanent successor Chairman of the JCRA is appointed.

 

The current Chairman is standing down at the end of his term on the 31st of December 2019. This appointment is to allow for a recruitment process that is currently in train to conclude and maintain the legal requirement for the Authority to consist of a Chair and two other Members. This appointment regularises the Authority’s performance of its functions, which is considered preferable to relying on a provision that rectifies defects in the Authority’s constitution.

 

In accordance with Article 2 of the States of Jersey (Appointment Procedures) (Jersey) Law 2018, the Chief Minister directed that the States be notified of the intended appointment, at least 2 weeks before the appointment is made. 

 

Resource implications:

Fees payable to the Chairman of the JCRA are sourced from the Annual Grant (£300,000 in 2019) made to the JCRA to administer the Competition Law as well as from the JCRA’s own accounts. There are no other financial or manpower implications for the States. 

Action required:

The Greffier of the States is requested to arrange for the attached report to be presented to the States as an ‘R’ to inform members of the Chief Minister’s intention to appoint Mr Masterton as JCRA Chairman in accordance with Article 3 of the Competition Regulatory Authority (Jersey) Law 2001.
