Records Advisory Panel: Appointment of chairman and members

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Records Advisory Panel: Appointment of Chairman and Members.

Decision(s): The Minister for Education Sport and Culture appointed the following five people to serve as members of the Records Advisory Panel –

Ms M M Billot

Mr H G Coutanche

Mr N A Jenner

Mr D R Maltwood

Mr M C Sunier 

The Minister further agreed to appoint Mr Coutanche as Chairman.  Officers are instructed to prepare a short report to provide information to the States.

Reason(s) for Decision:   Under Article 14 (2) of the Public Records (Jersey) Law 2002, the Minister for Education, Sport and Culture is responsible for the appointment of five people to serve on the Records Advisory Panel and for advising the States of those appointments.  The Minister is also responsible under Article 14 of the Law for appointing a chairman from the members of the panel.  

The terms of office of the current Records Advisory Panel expire on 12 December, 2009.   

Following an open appointments process, involving advertising of the forthcoming vacancies and formal interviews, the five people above have been recommended to the Minister for appointment for a term not exceeding six years.  

Mr H G Coutanche (who is the current chairman) and Mr D R Maltwood are existing members, and have offered their services for a second term not exceeding six years, as prescribed by Schedule 2 (1) 2 of the Law.

Mr Coutanche has also indicated a willingness to continue in the office of chairman, and the interviewing panel has recommended that the Minister confirm him in that role for a further period.

Action required: Officers are instructed to make the necessary arrangements with the Greffe in order to ensure that this action is duly reported in the States

Under Article 14 (2) of the Public Records (Jersey) Law 2002, the Minister for Education, Sport and Culture is responsible for the appointment of five people to serve on the Records Advisory Panel and for advising the States of those appointments.  The Minister is also responsible under Article 14 of the Law for appointing a chairman from the members of the panel.  

The terms of office of the current Records Advisory Panel expire on 12 December, 2009.
