Road Traffic (St. Martin) (Jersey) Order 1989: Amendment: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

INFRASTRUCTURE, HOUSING AND ENVIRONMENT

 

AMENDMENT TO ROAD TRAFFIC (ST. MARTIN) (JERSEY) ORDER 1989

 

 

Purpose of the Report

 

To amend the Road Traffic (St. Martin) (Jersey) Order 1989.

 

 

Background

 

A request has been received from the Connétable of St. Martin to add areas of prohibition of waiting on La Rue des Vaux de L’Eglise and La Rue de la Mare des Reines in St. Martin.

 

 

Discussion

 

The Connétable of St. Martin has requested that two new areas of prohibition of waiting be added to the Road Traffic (St. Martin) (Jersey) Order 1989 as detailed below:

 

La Rue de la Mare des Reines:

The Connétable has reported problems being experienced with parking in the areas requested which are causing difficulties for residents accessing their properties. Adding a Prohibition of Waiting as described below will enable the Parish Honorary Police to effectively deal with this. Add to Schedule 2 after the entry for La Grande Route de St. Martin – La Rue de la Mare des Reines in column 1, on the north side from the junction with La Grande Route de St Martin to a point 14 yards west then from a point 25 yards from the junction with La Grande Route de St. Martin to a point 21 yards further west and on the south side from the junction with La Grande Route de St Martin to a point 39 yards west.

 

La Rue des Vaux de L’Eglise:

The Connétable has reported problems being experienced with parking in the areas requested which are causing difficulties for residents accessing their properties. Adding a Prohibition of Waiting as described below will enable the Parish Honorary Police to effectively deal with this. Add to Schedule 2 after the entry for La Rue de la Mare des Reines – La Rue des Vaux de l’Eglise in column 1, on the north side from the junction with La Grande Route de Rozel to a point of 23 yards east and on the south side from the junction with La Grande Route de Rozel to a point 35 yards east in column 2.

 

 

Conclusion

 

The addition of the requested prohibition of waiting areas above will allow the Parish to police parking there.

 

 

Recommendations

 

The Minister is recommended to instruct Officers to issue Law Drafting instructions to amend the Road Traffic (St. Martin) (Jersey) Order 1989.
