La Route de St Marie: Proposed Junction Improvement at Bethlehem Methodist Church

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  La Route de St Marie – Proposed Junction Improvement at Bethlehem Methodist Church - PBA 0640

Decision(s):

  1. The Minister decided, as recommended by Jersey Property Holdings, to notify the States of his intention to:
    1. acquire, on behalf of the Public, for road improvement purposes, approximately 248 sq ft of land from “The Trustees for Jersey Methodist Church Purposes” at Bethlehem Methodist Church, La Route de St Marie, St Mary, for the sum of £248, and with the improvement works and the Vendor’s reasonable legal fees to be funded by the Public.
    2. to confirm the above decision after giving the States 15 working days’ notice of the transaction, and to cause the transaction to be completed.

Reason(s) for Decision:

  1. Under Standing Order 168 (1) (a) the Minister is obliged to notify the States that he has accepted the recommendation of Jersey Property Holdings to agree to the above land transaction.
  2. Under Standing Order 168 (5) the Minister hereby authorised the Attorney General and the Greffier to pass any contract which is required to be passed on behalf of the Public.  

Resource Implications:

  1. The financial implications of this decision are detailed in the accompanying report.
  2. There are no manpower implications in respect of this decision.
  3. The States’ asset balance sheet implications in respect of this decision will be accounted for at the time of the transaction.

Action required:

  1. In accordance with Standing Order 168 (3) this decision must be presented to the States at least 15 working days before the contract is passed.  After the expiry of 15 working days following presentation to the States the transaction may be concluded.

Property Transaction for Ministerial Decision - Minister for Treasury and Resources

 

 

La Route de St Marie – Proposed Junction Improvement at Bethlehem Methodist Church

Purpose

 

The purpose of this report is to seek Ministerial approval to acquire, from “The Trustees for Jersey Methodist Church Purposes”, an area of land at Bethlehem Methodist Church for road improvement purposes.

 

Current Situation

 

Jersey Property Holdings has been instructed by the Transport and Technical Services Department to arrange a minor land acquisition to improve the corner junction of La Route de St Marie and La Rue de la Potirons, St Mary; requiring approximately 23 sq m of land from Bethlehem Methodist Church situated at the south-west corner of the junction (see accompanying location plan).

 

The following heads of terms have been agreed with the Church:

 

Purchaser:   The Public of Jersey.

 

Vendor:   The Trustees for Jersey Methodist Church Purposes.

 

Area of land to be sold: An area of land measuring approximately 23 sq m (248 sq ft) at the north-east corner of Bethlehem Methodist Church (at the junction of La Route de St Marie and La Rue de la Potirons), as shown upon the attached A3 plan.

 

Consideration: The Purchaser will pay to the Vendor the sum of £248 (+GST if applicable), equating to £1/sq ft, for the subject area of land.

 

Costs: The Purchaser will be responsible for its own costs in connection with acquiring the land and passing contract, and will also meet the reasonable fees incurred by the Vendor in passing contract (the Purchaser will obtain a prior indication of fees from the Vendor’s lawyer).

 


 

 

 

 

 

Other terms: The Purchaser shall, at its own cost:

 

  • obtain planning consent for the proposed junction improvement works.
  • rebuild the Church’s roadside wall as shown upon the attached A3 plan to the reasonable satisfaction of the Vendor and the Planning and Building Services section of the Environment Department.

 

For the avoidance of doubt, the roadside wall will remain in the ownership of the Vendor.

 

Also for the avoidance of doubt, the Transport and Technical Services Department has confirmed that it has funds for this transaction and the road improvement works, and that the additional area of roadway will be incorporated into its ‘main road’ property asset.

 

Recommendation

 

It is recommended that the Public acquires, for road improvement purposes, approximately 248 sq ft of land from “The Trustees for Jersey Methodist Church Purposes” at Bethlehem Methodist Church, La Route de St Marie, St Mary, for the sum of £248, and with the improvement works and the Vendor’s reasonable legal fees being funded by the Public.
