A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Comments on Case

The decision to grant planning permission for 5 no units of accommodation in a farm style group was taken by the Environment and Public Services Planning Sub Committee on 14th July 2005. The Committee followed the officers recommendation that the re-development of existing commercial property to residential was acceptable and within the guidance of policy C5 of the Jersey Island Plan 2002. The policy makes exception where it can be demonstrated that a significant reduction in built floor area can be achieved and the re-development would give rise to substantial environmental gains. The policy preamble states more specifically that changes in the nature and intensity of use, careful consideration of siting and design and a restoration of landscape character should be considered.

It was considered that the inclusion of units 6 and 7, whilst still resulting in a modest reduction of built floor area, did not produce a significant enough reduction to justify the policy exception. Furthermore the siting of two dwellings to the north east of the site would represent building on an open area of the site that had no precedent for such structures, despite forming part of the car park to the current use. Dwellings in this location would lead to an erosion of the tighter, more traditional building mass that was achieved by the remainder of the re-development. The result would be sanctioning new dwellings in the green zone on open land where there was no precedent or policy justification.

Whilst the both the agent and applicant make an argument in this request that the re-development produces a reduction in built floor area, it fails to take account of the other factors that are required to secure the policy exception and as such does not give significant enough justification for the removal of condition 8 and allowing the two additional units.
