Proceeds of Crime and Terrorism (Miscellaneous Provisions) (Jersey) Law 2014: Appointed Day Act: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Minister approved the drafting of an Appointed Day Act for the bringing into force of the Proceeds of Crime and Terrorism (Miscellaneous Provisions) (Jersey) Law 2014 in whole on 4 August 2014.

 

Reason(s) for Decision:

 

The Appointed Day Act will bring into force the Proceeds of Crime and Terrorism (Miscellaneous Provisions) (Jersey) Law 2014 in whole on 4 August 2014. This date has been considered in relation to the upcoming assessment for AML/CFT compliance of Jersey by Moneyval commencing 1 September 2014 and consideration has also been given to an early appointed day act to allow the UK Government to hopefully proceed rapidly with the extension of the Palermo and Strasbourg Conventions to Jersey.

Instructions to the Law Draftsman to produce an Appointed Day Act for the bringing into force of the Proceeds of Crime and Terrorism (Miscellaneous Provisions) (Jersey) Law 2014

 

  1. The Law Draftsman will be aware that the Proceeds of Crime and Terrorism (Miscellaneous Provisions) (Jersey) Law 2014 (“the Law”) was adopted by the States on 18 February 2014, sanctioned by Order of Her Majesty in Council on 28 April 2014 and Registered in the Royal Court on 8 May 2014. The Law Draftsman will also be aware of the draft Proceeds of Crime and Terrorism (Tipping Off-Exceptions) (Jersey) Regulations 201- (“the draft Regulations”) that were lodged au Greffe by the Chief Minister on 3 June 2014 and are scheduled for debate by the States at the meeting commenting 14 July 2014.

 

  1. The Chief Minister would wish for the Appointed Day Act in respect of the Law to be debated immediately after the draft Regulations, if they are adopted by the States, on 14 July 2014.

 

  1. The Financial Crime Strategy Group has considered the appropriate date for the Law to be brought into force and has recommended to the Chief Minister that 4 August 2014 is the appropriate date. This date has been considered in relation to the upcoming assessment for AML/CFT compliance of Jersey by Moneyval commencing 1 September 2014 and consideration has also been given to an early appointed day act to allow the UK Government to hopefully proceed rapidly with the extension of the Palermo and Strasbourg Conventions to Jersey.

 

  1. The Law Draftsman is therefore requested to draft an Appointed Day Act pursuant to Article 52 of the Law to bring the Law into force in whole on 4 August 2014. These instructions are supported by Ministerial Decision MD-C-2014-0113.
