A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Criminal Injuries Compensation Board – extension of a legally qualified member of the CICB, Advocate R J Michel.
Decision(s): The Minister for Home Affairs decided to extend the appointment of Advocate R J Michel as a legally qualified member of the CICB for a period of 6 months from 30 April 2016 until 31 October 2016.
Reason(s) for Decision: The term of office of Advocate Richard Michel of the CICB expires on 30 April 2016. Advocate Michel wishes to remain in post for a further 6 months until the 31 October 2016 to enable his current ongoing complex cases to be completed, thus obviating the need for a new legally-qualified member to review the documentation and the Chairman is content for this extension. The Appointments Commission has indicated that it is also content for Advocate Michel to continue to serve for a further 6 months.

Criminal Injuries Compensation Board – proposed extension of appointment of one legally-qualified member

Introduction

The current term of office of Advocate RJ Michel as a legally-qualified member of the Criminal Injuries Compensation Board (CICB), is due to come to an end on the 30 April 2016.

Background

Advocate Michel, a legally-qualified Member of the CICB whose period of appointment is due to end on 30 April 2016, has requested the extension of his engagement for a further short period, until 31 October 2016, to enable his current ongoing cases to be completed, thus obviating the need for a new Board member to study the relevant documentation.

Advocate Michel was first appointed as a Member in February 1991, and was Chairman from 1994 until 2006, when he reverted to being a Member again.

Current situation

By the time Advocate Michel’s current term of office expires on 31 October 2016, he will have completed 25 years as a member of the CICB. The Chairman is content for him to continue to be a member of the CICB until 31 October 2013 to enable him to complete the ongoing cases. The Appointments Commission indicated that it is also content for Advocate Michel to continue to serve.

Recommendation

It is recommended that the Minister extends the appointment of Advocate Michel for the period until 31 October 2016.
