Helicopter Air Rescue Team (HART) training.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

WRITTEN REPORT

 

HART – Helicopter training

 

 

To consider granting exemptions to the Air Navigation (Jersey) Order 2000, as amended, to permit a helicopter to land away from Jersey Airport and to train in winching operations at five locations around the Island.

 

The Helicopter Air Rescue Team (HART) is a privately-funded group sponsored by a local resident, Mr Mark Burby, as a potential Search and Rescue operation based at Jersey Airport.

 

HART applied by letter dated 4th October 2005 (attached) to conduct certain flying training around the Island.  The Harbours and Airport Committee approved the exemptions as a one-off training exercise and referred the subject of a Search and Rescue operation in Jersey to the locally-based SAR Committee, chaired by the Harbourmaster Captain Howard Le Cornu.  The Committee referred the matter to the local SAR Committee in order to receive its advice concerning all aspects of the potential service to be provided.  That report is not yet available in writing.

 

The Committee authorised the President to permit the necessary exemptions to the Air Navigation Order for the helicopter to commence its training but, in the event, that training did not take place.  HART is now seeking to train under exactly the same criteria as the previously-issued exemptions allowed during the period 21 January and 23-28 January 2006 inclusive.  The previous letter of approval is attached as is a draft letter for the Assistant Minister to sign, if approved.
