Public Lotteries Board: Appointment of Member 2009.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister recommends the appointment of the following as member of the Public Lotteries Board for a period of five years commencing from the date of States approval, namely –  

Mr. Adrian Jonathan Garnier 

and agrees that a Report and Proposition be lodged with the Greffe for presentation to the States at the earliest opportunity.

Reason(s) for Decision:

The Minister in pursuance of Regulation 3(2) of the Gambling (Channel Islands Lottery) (Jersey) Regulations 1975, as amended, must recommend candidates as members of the Public Lotteries Board for appointment by the States to advise and assist the Minister in all matters concerning and promoting the conduct in Jersey of the Channel Islands Lottery.

Public Lotteries Board: Appointment of Member 2009.

REPORT  

The Public Lotteries Board is appointed by the States of Jersey on the recommendation of the Minister for Economic Development to advise and assist the Minister in all matters concerning and promoting the conduct in Jersey of the Channel Islands Lottery.  It exercises the functions attributed to it by or under the Gambling (Channel Islands Lottery) (Jersey) Regulations 1975, as amended. 

The Regulations require the States to appoint a Chairman and not less than 6 other persons to be members of the Board, all of whom shall be persons of integrity who are ordinarily resident in Jersey, and the appointments are for a period of 5 years. 

A vacancy on the Board was advertised on 2nd July 2009 in the Jersey Evening Post  in line with the Appointments Commission guidelines on appointments to quasi-autonomous non governmental bodies.  Of the two applicants interviewed, Mr. Adrian Jonathan Garnier was selected for States approval for appointment to the Board. 

The Minister accordingly proposes that, in accordance with Regulation 3(2) of the Gambling (Channel Islands Lottery) (Jersey) Regulations 1975, as amended, Mr. Adrian Jonathan Garnier be appointed. 
 

Resource Implications

There are no new financial, property, ICT or human resources issues arising.
