Amendment to Building Bye-Laws (Jersey) 2007 and supporting technical guidance

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Minister decided to make amendments to the building bye-law requirements relating to the conservation of fuel and power and ventilation in buildings, and to publish 5 new technical guidance documents in support of those changes.

Resource Implications:

No significant resource implications are envisaged. New calculations tools have been developed the costs of which have been allowed for in 2009 budget.

Proposed amendments to the Building Bye-laws (Jersey) 2007 to update requirements relating to conservation of fuel and power and ventilation in buildings.

 

 
 

Purpose of the Report

This report outlines the changes made to the Building Bye-laws (Jersey) 2007 following the Ministers’ previous decision (MD-PE-2008-0203) to amend the Bye-laws in respect of the requirements relating to conservation of fuel and power and ventilation in buildings.  

Bye-laws Amendments.

Amendments have been made as detailed in the public consultation paper issued in March 2008, but with changes to make compliance easier when using gas and oil for space heating appliances.  

The main changes can be summarised as follows: 

  1. Definition of building work extended to include work on the ‘thermal elements’ of a building.
  2. New requirements for the energy performance of new buildings to be calculated and the results to be provided to the department, and in the case of dwellings, a copy to the occupant.
  3. Targets have been set to limit the annual CO2 emissions from all newly constructed buildings.
  4. Requirements for ‘consequential improvements’ to be made when works are proposed on large commercial buildings.
  5. New requirements to improve energy performance by requiring sample air pressure testing for all new buildings, including dwellings.
  6. Improved standards to encourage greater use of energy saving insulation, more efficient heating boilers and low or zero carbon systems such as solar panels and heat pump technology.   

 

Technical Guidance Documents. 

Five new technical guidance documents have been produced for the purposes of providing guidance on meeting the requirements of the revised bye-laws. These are as follows:

(Ventilation) 2010 Edition. 

  1. Technical Guidance Document Part 11.1A. 

(Conservation of Fuel and Power in New Dwellings) 2010 Edition. 

  1. Technical Guidance Document Part 11.1B. 

(Conservation of Fuel and Power in Existing Dwellings) 2010 Edition. 

  1. Technical Guidance Document Part 11.2A. 

(Conservation of Fuel and Power in New Buildings other than Dwellings) 2010 Edition. 

  1. Technical Guidance Document Part 11.2B  

(Conservation of Fuel and Power in Existing Buildings other than Dwellings) 2010 Edition. 
 

Legal and resource implications

Article 31 (2) of the Planning and Building (Jersey) Law 2002 empowers the minister to make Building Bye-laws to prevent the waste, undue consumption or misuse of fuel and energy in or about buildings. Article 32 allows the minister to publish technical guidance in support of any requirement of the bye-laws. There will be no resource implications arising from the adoption of the new bye-law requirements. 

Recommendation 

That the Minister: 

  1. Makes amendments to the Bye-laws in accordance with the attached Building Bye-laws (Amendment) (Jersey) Order 2009.

 

  1. In accordance with his powers under Article 32 of the Planning and Building (Jersey) Law 2002, publishes the technical guidance documents 5, 11.1A, 11.1B, 11.2A and 11.2B for the purposes of providing guidance on meeting the requirements in Parts 5 and 11 of the second schedule to the Building Bye-laws (Jersey) 2007.
