A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

1. The Minister approved, as recommended by Property Holdings, for the Public of the Island to enter into an agreement with Mr Alan Rabet in relation to the lease of Warren Farm and Fields 684, 686, 689, 690 and 693.

The lease shall be for a period of 25 years, to commence on a date to be agreed between the parties, upon fully repairing terms. The lessee shall have the right to serve 12 months written notice on the lessor at anytime to terminate the agreement.

The rental shall be the market value of the demised premises. A rent free period will be granted during the first 5 years of the agreement to allow for the refurbishment of the demised premises in accordance with an agreed schedule of works.

2. Under Standing Order 168 (1) (a) and 168 (3) the Minister hereby notifies the States that he has accepted the recommendation of Property Holdings to agree to the above land transaction.

3. Under Standing Order 168 (5) the Minister hereby authorises the Attorney General and the Greffier to pass any contract which is required to be passed on behalf of the Public.

After the expiry of 15 working days following presentation to the States the transaction may be concluded.

Reason(s) for decision:

Under Standing Order 168 (1) (a) and 168 (3) the Minister is required to notify the States of his acceptance of recommendations to dispose, acquire, let or rent land on behalf of the Public of Jersey.

Action required:

1. After the expiry of 15 working days following presentation to the States the transaction may be concluded.

2. The Director of Property Holdings is to instruct the Attorney General and the Greffier to pass the necessary contract and to copy this decision to the Minister, the Treasurer and the Assistant Treasurer.

Proposed Transaction

Terms and conditions have been agreed between the Public of the Island and Mr Alan Rabet in relation to the property known as Warren Farm, Le Chemin de Noirmont, St Brelade. The demised premises comprise the farmhouse, farm buildings, with open courtyard and garden area and Fields 684, 686, 689, 690 and 693 measuring approximately 45 vergees.

The lease shall be for a period of 25 years, to commence on a date to be agreed between the parties, upon fully repairing terms. The lessee shall have the right to serve 12 months written notice on the lessor at anytime to terminate the agreement.

The rental shall be the market value of the demised premises, having regard to the lessee’s improvements. A rent free period will be granted during the first 5 years of the agreement to allow for the refurbishment of the demised premises in accordance with an agreed schedule of works.

On expiry of the 25 years, the lessee shall be given the option to renew the agreement for a further term of 25 years, on the same terms and conditions save as to the rent and option to renew. The new rent will be reviewed to market value of the property at the time taking account of the terms of the lease.

Following the initial refurbishment programme the demised premises shall be used for bona fide agricultural purposes, including an agricultural residential unit or such uses that shall be agreed in writing with the lessor, such consent shall be at the absolute discretion of the lessor having regard to the 1950 restrictive covenant and the proposed SSI status of the demised premises.

Field 684 is a designated SSI so will be grazed only in accordance with the management principles agreed with the Environment Division.

Assignment of the lease shall not be permitted, however, subletting or licensing of part of the residential unit may be permitted with the prior written consent of the lessor.

Recommendation

It is recommended that the Public enter into a lease with Mr Alan Rabet for Warren Farm and Fields 684, 686, 689, 690 and 693.
