Foot and Mouth Disease - Further Control Measure

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister decided to require imported horses to be accompanied by a private veterinary certificate stating where the horse has been prior to export and owner’s declaration stating all premises on which horses have been in 30 days before landing in Jersey, and to request the Law Draftsman to prepare an Order based on a brief prepared by the department.

Reason(s) for Decision:

Further case of FMD which may have been present, unidentified for several days.

Resource Implications:

Inspections of horses and accompanying certificates/declarations landing at St Helier Harbour by Department of Environment staff

Action required:

Instruct Law Drafting Officer to produce Order requiring certification and declaration as described.

Purpose of the Report

To prevent incursion of Foot and Mouth Disease to Jersey in accordance with stated aim of preventing incursion of Notifiable Disease.

Background

FMD has been confirmed in England on 3 August 2007. Measures to prevent introduction to Jersey in accordance with EU Decision 2007/554, as amended, have been implemented. A further case of disease (fifth) has been confirmed in the Protection Zone in Surrey on 18 September.

Discussion


The further, fifth, case of disease was detected by blood sampling sheep on the holding as part of routine surveillance in the Protection Zone. Subsequent culling has been carried out and samples tested positive for disease. The sheep had produced antibodies, indicating disease was present and undetected. The timescale is currently unknown.

Conclusion

Until further information is available on the latest outbreak, horses should not be permitted to land in Jersey if they have been on premises in the existing Protection or Surveillance Zones in the 30 days before landing.

Recommendation

Prohibit the import of horses to Jersey from England, Scotland or Wales unless approved by the States Veterinary Officer.
