MOTOR VEHICLES (CONSTRUCTION AND USE)(AMENDMENT NO. 9)(JERSEY) ORDER 200-
DISPLAYING 30MPH PLATES ON CERTAIN VEHICLES
Purpose of the Report
To consider the Motor Vehicles (Construction and Use)(Amendment No. 9)(Jersey) Order 200-, which will require motor vehicles whose permitted speed is restricted to 30 miles per hour to display circular plates to that effect.
Background
On 26th September, 2007, the States approved the Road Traffic (No. 58)(Jersey) Regulations 2007, which revised Schedule 2 of the Road Traffic (Jersey) Law 1956, clarifying the vehicles which are restricted to a maximum speed of 30 miles per hour, namely, large goods vehicles, large passenger carrying vehicles, medium-sized goods vehicles and vehicles drawing trailers. It was also the intention of the States when approving changes to speed limit policy in 2005 that the vehicles and trailers subject to a 30mph limit should display a sign indicating that restriction.
Discussion
The Law Draftsman was asked to prepare the necessary changes to the Order on the basis of a brief provided by the Department.
The Motor Vehicles (Construction and Use)(Amendment No. 9)(Jersey) Order 200- is attached for the Minister to make the Order. Making the Order provides for the form of plate to be affixed to the relevant vehicles and make it a requirement that from 1st January, 2008, that this form of plate should be displayed on all vehicles restricted to a maximum speed of 30 miles per hour.
The Order will also require low platform trailers to display rectangular plates identifying them as such.
The requirement to display these plates will not apply to vehicles brought temporarily into Jersey for a period of up to 3 months.
Recommendation
The Minister is recommended to make the Motor Vehicles (Construction and Use)(Amendment No. 9)(Jersey) Order 200- and request the Department to take the necessary action to implement the Order.
Reason(s) for Decision
To make the Motor Vehicles (Construction and Use)(Amendment No. 9)(Jersey) Order 200-, to require certain signs to be fixed to vehicles indicating restrictions applying to the vehicle.
Action Required
Minister to sign, seal and date the Motor Vehicles (Construction and Use)(Amendment No. 9)(Jersey) Order 200-.
Send the hard copy of the Order to the Publications Editor at the States Greffe as soon as it has been signed.
Request the Department to publicise the requirement prior to the requirement coming into effect.
