Employment (Minimum Wage) (Amendment No. 9) (Jersey) Order 2015

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Employment (Minimum Wage) (Amendment No. 9) (Jersey) Order 2015

Decision(s): The Minister made the Employment (Minimum Wage) (Amendment No. 9) (Jersey) Order 2015.

Reason(s) for Decision: Following a minimum wage review during the period May to September 2015, the Employment Forum publicised its recommendation to the Minister for Social Security on 28 September 2015. The Minister presented the Forum’s recommendation as a Report to the States on 30 September 2015 (R.109/2015, MD-S-2015-0077) and notified the States of her decision to accept the rates that the Forum recommended.

 

The Minister then requested law drafting for an amendment to the Employment (Minimum Wage) (Jersey) Order 2007 (MD-S-2015-0078). The purpose of the proposed amendment is to increase the minimum hourly rates of pay, from 1 April 2016, to the following rates;

  • A minimum wage of £6.97 per hour.
  • A first year trainee rate of £5.23 per hour.
  • A second year trainee rate of £6.10 per hour.

 

The Minister has lodged ‘au Greffe’ the Employment (Minimum Wage) (Amendment No. 12) (Jersey) Regulations 201- (MD-S-2015-0083) for debate at the States sitting of 1 December 2015. The Regulations would, from 1 April 2016, increase the maximum values that may be counted towards minimum wage or trainee rate pay where accommodation, or accommodation with food, is provided to an employee.

Resource Implications: There are no financial or manpower implications.

Action required: Policy Principal to notify the Greffier of the States and the Law Draftsman that the Order has been made so that it may be notified to the States, and forward the signed and sealed Order immediately to the States Greffe for publication and archiving.
