Howard Davis Farm - comments on Projet P.5/2007 lodged by Deputy Fox

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Reason(s) for decision:

The Minister is in agreement with the draft comments and wishes them to be presented for consideration by the States when the projet (P.5/2007) lodged by Deputy J. B. Fox seeking an investigation into alternative sites is debated.

Howard Davis Farm – Relocation of Jersey Dairy: Investigation into Alternative Sites P.5/2007. Comments of the Minister for Treasury and Resources

Introduction

Deputy J B Fox of St Helier lodged a report and proposition on 15 January 2007 entitled ‘Relocation of Jersey Dairy: Investigation into Alternative Sites’ (P.5/2007). This seeks to delay consideration of the Draft Howard Davis Farm (Partial Abrogation of Covenant) (Jersey) Law 200-, already lodged by the Minister for Treasury and Resources, to enable a full investigation of alternative sites for the relocation of the Jersey Dairy.

Draft Comments

It is not considered practical or essential to investigate other sites for the Dairy. This work has already been undertaken by the Dairy in its own consideration of alternative sites and no others were identified. Any further delay in the JMMB being able to relocate is going to be of major concern to the majority of milk producers. An investigation into other sites is likely to be a lengthy exercise, bearing in mind the planning, site investigation, environmental impact, services provision, traffic and access issues that need to be examined, with inevitable cost implications.

The Howard Davis Farm site has been assessed in depth and has received development approval. It is an appropriate site which meets the necessary criteria.

The Assistant Director has prepared the attached draft comments on Deputy Fox’s proposition for consideration by the Minister and if agreed, lodging with the States.

Recommendation

It is recommended that the Minister agrees the attached comments and instructs the Director of Property Holdings to request the Greffier of the States to lodge the comments on 25 January 2007.
