Battle of Flowers 2007 - Entertainment on Public Roads Application.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Reason(s) for decision:

The Minister approved the proposed road closures and traffic restrictions (following consultations), as the administering authority of the Entertainments on Public Roads (Jersey) Law 1985, to enable the Battle of Flowers 2007 event to be held.

THE BATTLE OF FLOWERS ASSOCIATION’S APPLICATION FOR ENTERTAINMENT ON PUBLIC ROADS DURING BATTLE OF FLOWERS 2007

Purpose of the Report

To obtain ‘Ministerial Decision’ regarding approval of road closures and traffic restrictions for the purpose of holding the Battle of Flowers 2007 event.

Background

The Promoter (Battle of Flowers Association) has submitted details of its proposed road closures for the 2007 event. The event is enabled by Order of the Transport and Technical Services Minister under Article 2 of the “Entertainments on Public Roads (Jersey) Law 1985”. A draft order has been prepared and circulated to the Connétables of St Helier and St Lawrence for consultation in accordance with the law.

Discussion

As per previous years the event arena will be from West Park to First Tower, however this year the seated stadium area will occupy all of lay-bys 1&2 and Lower West Park, on the opposite side. Lay-by 3 will be utilised as a rendezvous point for floats and will also be used for disabled parking. Lay-bys 5&6 will be used to park and display floats, as Millbrook Field has not been made available to the Battle as in previous years. Lay-by 7 will be used for support vehicles.

TTS Parking Control have approved the closure of all lay-bys in accordance with the Order and following negotiations with the Promoter are satisfied that the extended closure of lay-bys 1&2 to erect/dismantle stands has been kept to a practical minimum, given the potential loss of parking revenue to the Department (7 and 8 chargeable days respectively).

This year the Department, with the support of the Honorary Police and the Promoter, is proposing to allow westbound traffic on La Route de St Aubin to re-access Victoria Avenue from La Rue du Galet and ‘by-pass’ the Bel Royal bus lay-by. The aim of this measure is to eliminate ‘two way’ traffic flow through the lay-by (except buses), which in previous years has caused congestion as a result of its narrowness (which required a 'give and take' shuttle arrangement to manage the two way traffic flow). Traffic wishing to go up St. Peter’s Valley will however be permitted to continue along the inner road as per normal.

Therefore La Rue du Galet will not be closed this year for the event, nor on the advice of the Honorary Police will Pierson Road and Kensington Street. Otherwise Victoria Avenue and its approach roads will be closed as per normal between 9.30am and 7pm on Thursday 10th August for the main event and again between 6.15pm and midnight on Friday 11th for the “Moonlight Parade” (this closure will continue until 3am on Saturday 12th August for Victoria Avenue, east of First Tower).

Finally, the east entry arch will be erected in its normal position at West Park, however the western arch is likely to be erected at the western end of lay-by 2. Other details are as per the 2006 Order.

Recommendation

The Minister is recommended to approve the Battle of Flowers (Jersey) Order 2007 as prepared.

Action Required

Advise the Greffier that the Order has been made and forward the Decision Summary, Report, together with the signed and sealed Order to the Publications Editor at the States Greffe.
