Ann Court Demolition - Approval of Demolition Tender.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Ann Court demolition: the approval of the requisite tender

Decision(s):

The Minister:-

  • Agreed to the demolition of Ann Court and the interim use of the land for a car park until the decision to proceed with the development of the site is agreed by the Council of Ministers.
  • Accepted the alternative tender from DB Cummins (Jersey) Limited, in the amount of £349,540 on the basis that it is the lowest alternative tender and additional supervision will be provided.
  • Requested that the Treasury and Resources Minister similarly agree to the demolition all in accordance with Standing Order 168.
  • Authorised the virement of £500,000 from the Department’s rolling vote HYR000 to HYC016
  • Requested that the Minister for Treasury & Resources authorise the use of the proceeds from the sale of other assets to undertake the demolition and associated works which will ultimately facilitate the creation of replacement assets
  • Authorised the Director of Estate Services to sign the necessary contracts on his behalf.

Reason(s) for Decision:

Planning permission having been granted on the 19th January 2009 (application number P/2008/2409), to agree to the demolition of Ann Court and to accept the tender in accordance with Standing Order 168 and to ensure that the necessary funds are in place to undertake the works

Financial:            All costs to be paid from the project budget HYC016.

Action required:  Asset Manager to seek the approval of the Treasury and Resources Minister.
