Historic Child Abuse Enquiry - funding

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

REPORT

 

1.         Introduction

 

1.1        P91/2008 was lodged on 3rd June 2008 and was originally scheduled to be debated prior to the summer recess. Due to the heavy volume of States workload it was deferred to the sitting commencing 8th September 2008.

 

1.2        During the period between lodging and debate further information has come to light which has enabled the forecast of the expenditure on the enquiry to be improved. The forecast total expenditure which cannot be met from existing cash limits in 2008 has risen from £6 million to £7 million. The reasons for this increase are given below, together with a summary of the main items of expenditure for each department. All other aspects of P91 remain unchanged.

 

1.3        As a contingency and to prevent a further request the States are now asked to approve expenditure of up to £7.5 million.

2.2        The main cause of the increase is a rise in the Home Affairs forecast. This is due to three main reasons:

 

·         Withdrawal date from Haut de la Garenne – originally forecast to be early May but actual  date was early July. This has resulted in a significant increase in security costs.

·         Excavation of a second site.

·         Increase in forensic costs due to the number of items found at Haut de la Garenne.

 

 

3.         Nature of expenditure

 

The following represents a very brief summary of examples of the reasons for the additional funding sought:

 

  Health and Social Services - additional work for the Child Protection Committee, Professor Upex Inquiry, staff cover, Psychological Assessment Team Support.

  Education Sport and Culture – work at the Jersey Archive.

  Home Affairs – police costs.

  Property Holdings - loss of income from YHA, security of Haut de la Garenne and reinstating excavated areas of the site.

  Law Officers – detailed estimates of probable court and case costs plus full-time Lawyer at Police Headquarters for enquiry.

  Economic Development - campaign to increase forward bookings and build awareness of Jersey as a holiday destination.

  Chief Ministers’ – public relations.

 

 

4.         Financial/manpower implications

 

            As previously indicated, payment will only be made against expenditure actually incurred and validated by the Accounting Officer of the relevant Department.     States revenue expenditure for 2008 will rise by up to £7.5 million.
