Public Employees Contibutory Retirement Scheme: Membership of Committee of Management

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Chief Minister, acting in accordance with Regulation 3 (2) of the Public Employees (Contributory Retirement Scheme) (General) (Jersey) Regulations 1989, agreed to lodge ‘au Greffe’ a Report and Proposition recommending the appointment of the Committee of Management of the Public Employees Contributory Retirement Scheme for the States to debate at the earliest opportunity.

Reason(s) for Decision: The Committee of Management of the Public Employees Contributory Retirement Scheme exercises all such powers, authorities and discretion as are vested in it by the Regulations governing the scheme.

 

The previous 3 year term of office for members finishes on 31st December 2012 and the decision has accordingly been taken to recommend the appointment of the Committee of Management for a further 3 year period.   

 

The appointments have been considered and supported by the States Employment.

Resource Implications: There are no resource implications.

Action required: The Greffier of the States is requested to arrange for the report and proposition to be lodged ‘au Greffe’ for States debate at the earliest opportunity.

THE STATES are asked to decide whether they are of opinion -

 

to approve, in accordance with Regulation 3(2) of the Public Employees (Contributory Retirement Scheme) (General) (Jersey) Regulations 1989, the appointment of the Committee of Management, for a period of three years commencing 1st January 2013 as follows -

REPORT

 

The Regulations provide that a Committee of Management will be established which shall have and exercise all such powers, authorities and discretion as are vested in it by the Regulations governing the scheme.

 

Under the Regulations the membership comprises six employer representatives and six member representatives or such greater equal number as may be determined from time to time by agreement between the Chief Minister and the representative associations.  The proposed membership is for six on each side.  

 

Three of the employer representatives are chosen by the Chief Minister and these are:-

  • Mr S Laing
  • Mr J Mills
  • Mr S Lusby

 

The remaining three of the employer representatives are chosen by the Minister for Treasury & Resources and these are:-

  • Mr S M Patidar,
  • Mr S Warner
  • Mr T Le Sueur

 

The member representative nominations have been submitted by the Public Employees Pension Scheme Joint Negotiating Group.
