Les Jardins Car Park, St. Helier: Temporary Closure: 20th October 2019

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

TEMPORARY CLOSURE OF LES JARDINS CAR PARK FOR MOTORSPORT

 

EVENT ON 20th OCTOBER 2019

 

Purpose of the Report

 

To request the temporary closure of Les Jardins Car Park on Sunday 20th October 2019 between 8am and 6pm to facilitate a motorsport event taking place within the car park.

 

 

Discussion

 

A request has been received from the Jersey Motor Cycle and Light Car Club (JMC&LCC) for the closure of Les Jardins Car Park on Sunday 20th October 2019 so they can facilitate a motorsport event inside the car park. This is the second year the request has been received as the event took place in 2018 and was a success. The Club also ensured the car park was returned in a clean and tidy state.

 

The JMC&LCC have all the required insurance in place and have completed the appropriate risk assessments, in line with the ACU (Auto-Cycle Union) Code of Practice for this type of event where motorcycles will race against the clock round a prepared winding track in the same way they did previously.

 

The JMC&LCC will undertake a letter drop to all businesses situated within the Waterfront Complex and also to each of the residential flats that overlook the area in advance of the event.

 

The loss of parking in Les Jardins during the period of the proposed closure would not have a major impact on motorists wishing to come to St Helier as there are sufficient spaces available in other car parks such as Patriotic Street, Sand Street and the Esplanade to accommodate displaced vehicles.

 

 

Recommendations

 

The Minister is recommended to approve the temporary closure of Les Jardins Car Park on Sunday 20th October 2019 to enable the motorsport event to take place.
