Road Traffic (St. Brelade) (Jersey) Order: Amendment: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

ROAD TRAFFIC (ST BRELADE) (JERSEY) ORDER 1990 AMENDMENT

 

REQUEST

 

 

 

Purpose of the Report

 

To obtain Ministerial approval in principle for minor changes to the descriptions of prohibited road side waiting sections in Les Quennevais Park Estate and Le Clos des Sables as described in the Road Traffic (St Brelade) (Jersey) Order 1990 and to ensure that  the descriptions match the existing sections, as marked on the roads.

 

 

Background

 

The Connétable of St Brelade has requested the Minister to approve the descriptive changes in order that policing of the waiting restrictions can be carried out more effectively.

 

Discussion

 

The text changes to Schedule 2 of the Road Traffic Order are as follows:

 

Les Quennevais Park – to read

South side, from western boundary of the property known as No. 70 Les Quennevais Park to the eastern boundary of the property known as No. 71 Les Quennevais Park.

 

Le Clos des Sables – to read

First paragraph

Both sides (from the eastern boundary of 117 Le Clos des Sables for a distance of 91 yards in a southerly direction).

 

Fifth paragraph

West side (from its junction with La Route Orange to the northern boundary of the property known as No. 59 Le Clos des Sables for a distance of 51 yards in a northerly direction).

 

Sixth paragraph

East side (from its junction with La Route Orange to the northern boundary of the property known as Langdale for a distance of 61 yards in a northerly direction).

 

Seventh paragraph

East side (from a point adjacent to the southern boundary of the property known as No. 152 Le Clos des Sables for a distance of 34 yards in a northerly direction).

 

 

 

Eighth paragraph

West side (from a point adjacent to the southern boundary of the property known as No. 152 Le Clos des Sables for a distance of 32 yards in a northerly direction).

 

Recommendation

 

The Minister is recommended to approve the request.
