Property Holdings - authority to pass contracts

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

A decision made (20.02.06) to authorise the power to pass contracts in regard to the following land transactions;- MD-TR-2006-0007, MD-PH-2006-0002, MD-PH-2006-0004, MD-PH-2006-0011, MD-PH-2006-0007, MD-PH-2006-0008, MD-PH-2006-0009, MD-PH-2006-0010.

Decision(s): The Minister hereby authorises the Attorney General and the Greffier of the States to pass any contracts on behalf of the Public of Jersey that may be necessary in regard to the following land transaction

decisions -

MD-TR-2006-0007 - lease of warehouse to Jersey Employment Trust - Sale of land at Belle Vue to Mr R Rive;

MD-PH-2006-0002 - Assisted House Purchase Scheme - Sale of 7 La Place du Puits to Mrs E Smith;

MD-PH-2006-0004- Lease of Les Landes Racetrack to Jersey Race Club;

MD-PH-2006-0011- Assisted House Purchase Scheme - Sale of 3 Les Buttes to Miss L Burnham;

MD-PH-20006-0007- Lease of office space at Broadcasting House to Mr B Davies;

MD-PH-2006-0008 - Lease of office space at Broadcasting House to Miss T Ward;

MD-PH-2006-0009 - Lease of office space at Broadcasting House to Mr T Evans;

MD-PH-2006-00010 - Lease of office space at Broadcasting House to Saxon Bennett Ltd.

Reason(s) for decision:

Under Standing Order 168 (5), with the authority of the Treasury and Resources Minister, the Attorney General and the Greffier of the States may pass any contract which is required to be passed on behalf of the Public of Jersey.

Action required:

Director of Property Holdings to report to the Law Officers’ Department and Greffier of the States that the Minister has authorised the passing of contracts related to the above decisions.
