Approval of a Change in Policy Concerning the Application of Regulation 3 of the Policing of Beaches (Jersey) Regulations 1959

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision:

The Minister approved a change in policy concerning the application of Regulation 3 of the Policing of Beaches (Jersey) Regulations 1959, as amended. Specifically he agreed to consider applications from concessionaires wishing to display advertising on items associated with the  trading operation of the beach concession. The Minister resolved to determine each application received on its own merits.

Reason for Decision:

A request has been made by one of the concessionaires to put corporate logos on the sails of blokarts – this would give some additional revenue and also provide the clients with additional advertising. It has been agreed that support should be given to Tourism providers and this would assist.

Resource Implications:

There are no manpower implications for the States as a result of the ministerial decision.

Action required:

Peta Philo to write to concessionaires to inform them of policy change.

The Tourism Committee under its administration of these Regulations had control of all leases and was also responsible for the upkeep and maintenance of the properties. It was agreed that all premises operating under the Regulation would conform to the “Tourism Branding” in an endeavour to create uniformity, thus umbrellas etc advertising popular soft drinks were actively discouraged.

 

Since the Ministerial system of government all leased properties fall under the control of Property Holdings meaning a loss in revenue of £14,000.00, however, this is mitigated by the reduction in E D staff and maintenance costs.

 

A concessionaire has expressed an interest in placing the logos of her corporate clients on the sails of blokarts; partly as a result of requests and partly as a source of additional revenue.

 

At the Tourism presentation to the industry last week it was agreed that additional support should be made available to industry partners and to allow concessionaires to earn advertising revenue at no cost to the tax payer would appear to be reasonable.

 

The placing of any advertising material on any beach is an act that requires the permission of the Minister. Each application would be judged on its merits and would only be granted provided there was no compromise on safety.
