Road Traffic (St. Martin) (Jersey) Order 1989 - Amendment.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister agreed to amend the Road Traffic (St Martin) (Jersey) Order 1989.


Reason(s) for decision:

To prohibit vehicles exceeding 6 feet 6 inches from waiting on sections of Le Mont de Gouray; and also to prohibit vehicles from waiting on these sections of the road for a period not exceeding 12 hours in any 24 hours.

To prohibit vehicles from waiting on a section of New Road and Beach Road, and to prohibit waiting for a period not exceeding 12 hours in any 24 hours on the lay by on Le Mont de Rozel.


Action required:

Officers to instruct the Law Draftsman to prepare an Amendment to the order for subsequent submission to the Minister.

TRANSPORT AND TECHNICAL SERVICES

ROAD TRAFFIC (ST MARTIN) ( JERSEY ) ORDER 1989 - AMENDMENTS

Purpose of the Report

To improve the traffic management on three roads in the Parish of St Martin.

Background

The Connétable of St Martin has contacted the Department requesting the Minister for Transport and Technical Services to amend the Road Traffic (St Martin) (Jersey) Order 1989, to prohibit vehicles exceeding 6 feet 6 inches from waiting on sections of Le Mont de Gouray, and also to prohibit vehicles from waiting on these section of the road for a period not exceeding 12 hours in any 24 hours.

The Connétable has also requested the Minister to prohibit vehicles from waiting on a section of New Road and Beach Road, and to prohibit waiting for a period not exceeding 12 hours in any 24 hours on the lay-by on Le Mont de Rozel.

Discussion

  1. The request with regard to Le Mont de Gouray is considered necessary to prevent large vehicles from causing congestion on the hill, and also to prevent vehicles from waiting for excessive periods of time.
  1. New Road and Beach Road are narrow parish roads, and the Parish are mindful of the danger of congestion caused by vehicles parking on the bends close to its junction with La Rue a Don.
  1. The request with regard to Le Mont de Rozel is considered necessary to ensure that vehicles, currently being left in the lay-by for up to six weeks, do not abuse the parking facilities of the lay-by.

Recommendation

The Minister is recommended to approve the requests.
