Management Restructure in the Customs and Immigration Service.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Rationalisation of the management structure following the merger of Customs and Immigration in 2005, the merger of the Frontier teams and the subsequent retirement of the Director Immigration and Nationality.

Resource Implications:

Savings in staff budget as a grade 15 post is replaced by a grade 13 post.

Following the imminent retirement of the Director Immigration and Nationality (31 August 2008) the opportunity has been taken to rationalise the management and reporting lines within the Service.  This note is to advise and seek the endorsement of the Minister for the changes.

The current management structure of the Service is shown at Appendix 1.   

Prior to the merger of the Customs and Immigration Frontier teams in 2006 the Immigration Officers reported directly to the Director Immigration and Nationality and the Customs Officers reported directly to the Director Law Enforcement.  Following the merger the reporting lines became less clear as is shown in the organisation chart. 

The merged frontier teams have gradually become more effective as the integration and training is consolidated which has highlighted the need for a single management line. 

The planned new management structure is shown at Appendix 2 and is due to be implemented on 1 September 2008. 

The Director Law Enforcement will have, through his Assistant Director, sole responsibility for the Frontier Teams. 

The other responsibilities of the former Director Immigration and Nationality post will be allocated between two posts. The technical aspects of the old Director’s post will be undertaken by a new Assistant Director post.  The policy and Director level aspects will be undertaken by the existing Director Customs and Excise post and, where appropriate, the Head of Service. 
 
 
 
 

The 'Director Customs & Excise' title has been changed to 'Director - Legal Status & Revenue' to reflect the new responsibilities for that post.  The term 'Legal Status' was chosen because a definition of the term when applied to persons includes the following concepts: "citizenship, nationality, naturalisation, leave to remain and immigration". 

The new Assistant Director post will be titled ‘Immigration Casework and Nationality’.
