Advertising on buses, bus shelters and car parks

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

A decision made (16.02.06) that agreed advertising should be allowed in car parks and possibly on buses and in bus shelters.

ADVERTISING - EXPRESSIONS OF INTEREST FOR ADVERTISING ON BUSES, BUS SHELTERS & CAR PARKS

Purpose of the Report

To seek the Minister’s approval to obtain Expressions of Interest from companies wishing to provide advertising on buses, bus shelters and car parks.

Discussion

  1. The previous Environment and Public Services Committee approved the principle of allowing advertising on buses and bus shelters at its meeting on 15th September 2005 and the Department is now wishing to progress this by seeking Expressions of Interest by way of placing an advert in the Jersey Evening Post. The previous Committee considered that the income from advertising on bus shelters should be allocated to the maintenance and upkeep of the structures. A copy of the relevant Act (A8 of 15/09/2005) is attached which sets out the principles on which this decision was made.
  1. Another area which could also be considered for appropriate advertising would be the inside of the public multi-storey car parks and the Minister is asked to agree that this is also included in the scope. The Road Traffic (Public Parking Places) (Jersey) Order 2004 allows advertising in car parks with the authority of the Minister. The revenue can be utilised to increase the income to the Car Park Trading Fund.
  1. The possibility of advertising on taxis has been raised in the past but this does have more issues attached to it – particularly ensuring the standard and quality of the adverts. It is recommended that, at this juncture, expressions of interest are sought just for buses, bus shelters and car parks with a decision regarding taxis to be taken after discussions with representatives from the taxi and cab drivers and firms.

Recommendation

The Minister is asked to approve:

  1. that approved advertising by a named supplier in public car parks be allowed; and
  1. Expressions of Interest are sought for advertising on buses, bus shelters and public multi-storey car parks.
