Memorandum of Understanding with Jersey Water.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

MEMORANDUM OF UNDERSTANDING WITH JERSEY WATER

Public

Purpose of the Report

To advise the Minister for Planning and Environment on the background to the Memorandum of Understanding with The Jersey New Waterworks Company Ltd. (Jersey Water) that is currently in place and to request the Minister to sign an amended version to take into account the changes in the Machinery of Government.

Background

The Minister for Planning and Environment acts as the Regulator for the purposes of the Water (Jersey) Law, 1972 as Amended under which Jersey Water is responsible for the provision of wholesome water for domestic purposes. The current Memorandum of Understanding between Jersey Water and the then Environment and Public Services Committee in relation to the monitoring and other arrangements appertaining to the Company’s operational activities under the Law came into force on the 1 January 2004 and is due to expire on the 31 December 2008. A replacement is now proposed to take into account the change to Ministerial Government.

Discussion

A revised Memorandum of Understanding between Jersey Water and the Minister for Planning and Environment has been drafted to take into account the change to Ministerial Government. The opportunity was also taken to clarify the situation with regard to complaints regarding water quality submitted by consumers and the subsequent action to be taken by Designated Officers of the Environment Division, (Sections 2.4.1 and 2.4.2). A list of Designated Officers is given in the Annex to the Memorandum. This Memorandum will be deemed to have come into force on the 1 July 2006 and will expire on the 31 December 2008.

A draft copy of the Memorandum was submitted to the Company and has been approved by the Board. A copy of the revised Memorandum is attached to this Report. Engrossed copies of the Memorandum will be available for signing by the Minister for Planning and Environment and representatives of the Company.

Recommendation

The Minister is asked to approve the revised Memorandum of Understanding with Jersey Water and to sign the engrossed document. The Minister is also asked to authorise officers to send a copy of the Memorandum of Understanding to the Company to be signed by its representatives.
