Road Traffic (Public Parking Places - Charges) (Jersey) Order : Proposed amendment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

ROAD TRAFFIC (PUBLIC PARKING PLACES - CHARGES)

 

(JERSEY) ORDER 2010

 

 

Purpose of the Report

 

To remove Beaumont, Gunsite Car Park and the unnamed road that runs between the Gunsite Slipway and La Route de la Haule Car Park from the list of car parks where a Season Ticket for both normal and low-emission vehicles can be used.

 

 

Background

 

Both the Beaumont, Gunsite Car Park and the unnamed road that runs between the Gunsite Slipway and La Route de la Haule Car Park have been scheduled in the Road Traffic (Public Parking Places) (Jersey) Order 2006 as being areas where a maximum stay period of 4 hours during any one visit is permitted. The areas are both scheduled as being car parks where the parking charges are 1 parking unit for each period of 2 hours or part of that period. These areas are also included in the Road Traffic (Public Parking Places – Charges) (Jersey) Order 2010 as areas where a Season Ticket for both normal and low-emission vehicles can be used.

 

All other scheduled car parks where there is a maximum stay period of less than 12 hours in any continuous 24 hour period are excluded from the list of those where either type of Season Ticket can be used so that enforcement of the maximum stay rule can be enforced. Currently this is not possible with the Beaumont, Gunsite Car Park and the unnamed road that runs between the Gunsite Slipway and La Route de la Haule Car Park as a Season Ticket can be used in them.

 

The removal of these two car parks from the list of those where Season Tickets can be used will result in the use of only paycards as payment methods in line with all other short stay chargeable car parks and will enable efficient policing of the area to be carried out. This will result in an efficient turnover of spaces enabling more people to take advantage of the parking there.

 

 

Discussion

 

Officers would support the removal of Beaumont, Gunsite Car Park and the unnamed road that runs between the Gunsite Slipway and La Route de la Haule Car Park from the list of car parks where a Season Ticket can be used.

 

 

 

 

 

 

Recommendations

 

The Assistant Minister is recommended to approve the request to remove Beaumont, Gunsite Car Park and the unnamed road that runs between the Gunsite Slipway and La Route de la Haule Car Park from the list of car parks where a Season Ticket can be used and to instruct Officers to instruct the Law Draftsman to prepare an Amendment to the Road Traffic (Public Parking Places - Charge) (Jersey) Order 2010 to incorporate this.

 

 

Reason(s) for Decision

 

To bring the charging scheme applicable in these two car parks in line with all other scheduled short stay car parks and to enable efficient policing of the areas which will ensure spaces become available for use by the public.
