A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Appeal under Article 108 of the Planning and Building (Jersey) Law 2002 against a decision to grant planning permission, P/2020/0654, for “Convert and extend existing garage to form 1 No. 3 bed dwelling. Create new vehicular access onto La Rue de Sergent” at Land West of 13 Clos du Ruisseau, La Grande Route de St Martin, St Martin.

Decision:

The Minister allowed the appeal and refused to grant planning permission, reference P/2020/1148, for the following reasons:

 

  1. The proposed dwelling, by virtue of its height, design and proximity to the Grade 3 listed Brook Farm, and the proposed intervention in the roadside bank, would neither preserve nor enhance the setting of the listed building and the proposal is, therefore, contrary to policies SP4, HE1, GD7 and BE6 of the Island Plan 2011 (Revised 2014).

 

  1. The proposed vehicular access and associated visibility splays would result in the loss of an area of roadside banking which would be damaging to the landscape character of this rural lane and contrary to Policies GD1 and NE4 of the Island Plan 2011 (Revised 2014).

 

Reason for Decision:

 The Minister gave full consideration to the assessment and recommendation of the Inspector as detailed in his report to the Minister.

 

However, the Minister considered that the impact of the proposed development upon the setting of the listed Brook Farm, and upon the rural landscape character of the area would not be supported by the policies of the Island Plan and would not, therefore, be acceptable.
