Lease of Fields 800, 800A and 801, Rear of JCG Preparatory School, Claremont Road, St Saviour.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

1. The Minister approved, as recommended by Property Holdings, for the Public to enter into a four year lease with Jersey Royal (Potato Marketing) Limited of Fields 800, 800A and 801, St Saviour for a rental of £420.00 per annum from 24th December 2006.

2. Under Standing Order 168 (1) (a) and 168 (3) the Minister hereby notifies the States that he has accepted the recommendation of Property Holdings to agree to the above land transaction.

3. Under Standing Order 168 (5) the Minister hereby authorises Property Holdings to pass any contract which is required to be passed on behalf of the Public.

After the expiry of 15 days following presentation to the States the transaction may be concluded.

Reason(s) for decision:

To allow the Public to formalise the historic tenure of this land by Jersey Royal (Potato Marketing) Limited since 1993.

Under Standing Order 168 (1) (a) and 168 (3) the Minister is required to notify the States of his acceptance of recommendations to dispose, acquire, let or rent land on behalf of the Public of Jersey.

Action required:

1. After the expiry of 15 days following presentation to the States the transaction may be concluded.

2. After the expiry of 15 days following presentation to the States, Property Holdings to pass any contract which is required to be passed on behalf of the Public.

Terms and conditions have been agreed between the Public of the Island of Jersey and Jersey Royal (Potato Marketing) Limited in relation to the lease, to the latter, of Fields 800, 800A and 801, St Saviour.

Jersey Royal (Potato Marketing) Limited, previously Fairview Farm Limited, have tenanted these three fields under a verbal agreement, with the former Agriculture and Fisheries Department, since 1993. The three fields together measure an area of 14.00.00 vergées. The fields now have organic status which was arranged and paid for by Jersey Royal (Potato Marketing) Limited.

The new lease shall be for a period of four years, with effect from 24 December 2006, at a rental of £420.00 per annum. It is proposed that a JRPI rent review is undertaken at the commencement of year three, in December 2008.

Recommendation

It is recommended that the Public enter into this four-year lease to Jersey Royal (Potato Marketing) Limited of Fields 800, 800A and 801, St Saviour.
