Energy from Waste Facility - Reserved Matters Submission.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Solid Waste Strategy – Energy from Waste Facility – Reserved Matters Submission and related Bus Depot Compensatory Planning Application

Decision(s): The Minister for Transport & Technical Services approved the submission of Reserved Matters relating to the planning consent for the La Collette Energy from Waste facility and a related planning application for Bus Depot Compensatory provision.

Reason(s) for Decision: The Reserved Matters must be met to finalise planning consent for the Energy from Waste Facility. A compensatory provision of parking is required for the TS Bus Depot to offset land that would be lost as part of the Energy from Waste facility site development road.

Resource Implications: The Reserved Matters include design changes to the external structure of the Energy from Waste facility that have been developed by Hopkins Architects Limited. The resource implications of these changes can be met within the overall resource package agreed by the States within P73/2008 on 9 July 2007.                            

Action required:   That the Minister for Transport and Technical Services instruct the Chief Officer to submit the Reserved Matters submission and implement the associated public consultation strategy and submit the related Bus Depot compensatory planning application.

TRANSPORT AND TECHNICAL SERVICES  

ENERGY FROM WASTE FACILITY - RESERVED MATTERS SUBMISSION  
 

Purpose of the Report  

This report seeks the Minister’s approval of the attached Energy from Waste Facility Reserved Matters Submission and a related Bus Depot Compensatory Planning Application. 
 

Background  

Outline Planning Permission was granted for a Energy from Waste Facility, site development road and associated landscaping on 26th October 2007 (PP/2007/0050). As part of the granting of permission a number of Reserved Matters were conditioned.  

The States of Jersey approved P72/2008 Energy from Waste Facility: Establishment and Acceptance of Tender” on 9 July 2008. The Minister approved the appointment of the CNIM Consortium as Preferred Bidder on 19 May 2008 (MD-T-2008-0035).  

Detailed design works have been undertaken with Hopkins Architects Limited and the Preferred Bidder to the point where the Reserved Matters submission can now be made. 

Discussion  

The Reserved Matters submission includes the following elements: 

  • Details of the siting, design and external appearance of the building. This is broadly similar to the building profile approved at Outline stage but has been enhanced by Hopkins Architects Limited and now includes glazing to North West and South East elevations which improves the visual appearance, sustainability and working environment within the facility.

 

  • Details of the enhanced landscaping. This has been prepared by Townshend Architects Limited and improves the visual appearance and ecological impact of the landscaping.

 

  • A Construction Management, Traffic Management and Construction Environmental Action Plans are included detailing how the Preferred Bidder proposes to carry out construction in a considerate way.

 

  • A schedule of drainage is included.

 

  • A strategy for dealing with major incidents including access arrangements is provided. This includes a proposed emergency access from Green Street Slipway to the site on the request of the Fire Service.

 

  • A strategy for implementing recommendations of the Health Impact Assessment and for conducting air quality monitoring is provided.

 

  • A compensatory area for the Land for Recreation to be occupied by the Energy from Waste facility is identified

 

  • A programme of public consultation and a recommended “Percentage for Art” contribution is submitted.

 

Approving the Reserved Matters submission does not commit the Minister to the full construction contract for the Energy from Waste Facility. The intention is for the full Engineering Procurement and Construction (EPC) contract to be progressed after the Reserved Matters have been considered and approved by the Minister for Planning and Environment and this final approval will be subject to a separate Ministerial Decision.  

Enabling works, including the site development road would commence following the Reserved Matters approval. 

Approval is sought for submission of a related planning application which provides a compensatory area for the TTS Bus Depot to offset land which would be lost due to development of the Energy from Waste Site Development Road. 
 

Recommendation 

It is recommended that the Minister for Transport and Technical Services approve the Energy from Waste Facility - Reserved Matters Submission and the related planning application for Bus Depot Compensatory Provision.

The Reserved Matters must be met to finalise planning consent for the Energy from Waste Facility.
