Sea Fisheries (General Fees) (Jersey) Order 2010: Fee Increases 2014: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:
Increase of fees for fishing boat licences, scallop permits and fisheries licences.

Decision(s):

The Minister approved the increase in fees for 2014 by 2.5%, as per the table in the appended report and being the figure recommended by the States of Jersey Treasury, and asked for the necessary law drafting work to be undertaken to amend the Sea Fisheries (General Fees)(Jersey) Order 2010.

Reason(s) for decision:

To enable Marine Resources to increase its fees and charges in line with the Anti-Inflation Strategy agreed by the States.

Resource Implications:  

There are no manpower implications for the States as a result of this ministerial decision.

Action required:  

Assistant Director Marine Resources to submit the relevant brief to the Law Draftsman.

INCREASES IN FEES

 

Purpose of the Report

 The Minister for Economic Development is asked to approve a request to increase the various fees and charges for licences and permits administered under the Sea Fisheries (Jersey) Law 1994 with effect from 1 January 2014, as per the recommendation below.


Background
The Department currently charges a fee for the work involved in administering the following:
Issue of new fishing vessel licences

Issue of commercial scallop diving licences

Issue of recreational scallop diving licences

Application and grant fees for concession licences for fish farming

Annual fees per concession for fish farming licences

 

Details
Charges and fees are set out in the Sea Fisheries (General Fees) (Jersey) Order 2010.

 

It is necessary to decide on any increases in fees as legislation needs to be formulated prior to fees being charged from January 2014.

 

Treasury and resources Policy has suggested that fees should again not exceed 2.5%

Recommendation

The Minister is recommended to approve the increases to fees as specified in the table above and to instruct the Assistant Director Marine Resources to issue appropriate law drafting instructions for an amendment to the Sea Fisheries (General Fees) (Jersey) Order 2010.
