French and English Harbour: Mixed Use Cyclepaths

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister agreed to amend the Cycle Tracks (Jersey) Order 2000 following construction of the new paths around the English and French Harbours.

 

Reason(s) for Decision: To permit cycling on the new mixed use paths.

 

Resource Implications: DfI Officer and Principal Legislative Drafter’s time are the only current requirements. The signing requirements are minor (below £5,000) and will be funded from the Capital Programme as part of the path construction budget.

 

Action required: Officers to instruct the Principal Legislative Drafter to prepare an Amendment to the Order for subsequent submission to the Minister.

FRENCH AND ENGLISH HARBOUR MIXED USE CYCLEPATHS

 

 

Purpose of the Report

 

To amend the Cycle Tracks (Jersey) Order 2000 following construction of the new paths created at the English and French Harbours.

 

 

Background

 

The South Coast cycle route is the premier cycling route in Jersey running from Corbiere to Havre des Pas. The final links are now being constructed from Commercial Buildings to South Pier around the English and French Harbours, where previously cyclists had to leave the cycle paths and re-join the road. When traveling southbound re-joining traffic involved crossing the road at hazardous locations. The path at the English Harbour is a new footway on the inside of the historic harbour wall within the existing highway which will provide mixed use for pedestrians and cyclists. The French Harbour will be a new boardwalk over the harbour which will provide a new walking and cycling route of the same arrangement. These paths have been designed and constructed as mixed use cycle paths for scheduling in the Cycle Tracks (Jersey) Order.
