Canons of Church of England in Jersey

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  The Chief Minister agreed to lodge ‘au Greffe’ the attached R & P regarding the amendment to the Canons of the Church of England in Jersey.

 

Decision(s): The Chief Minister seeks the endorsement by the States to amend the Canons of the Church of England in Jersey as approved by the Right Reverend the Bishop of Winchester, the Dean of Jersey, the Ecclesiastical Court and the Deanery Synod in Jersey.  The draft Canons may then be submitted to Her Majesty with a request that an Order in Council be issued to bring them into force in Jersey. 

 

Reason(s) for Decision:  This project has been ongoing for almost fifteen years and within the last 18 months the issue that was holding up the process relating to the practises needed in place if a Priest were to be accused of any wrongdoing, has finally been resolved. 

 

These amended Canons have been amended with the consent of the Bishop of Winchester, the Dean of Jersey, the Clergy in the Ecclesiastical Court and these bodies feel that the Amended Canons should be laid before the States of Jersey as they provide solid legal framework within which the Church can fulfil its ministry within the island. 

 

To come into force, the States Assembly must agree these Canons and it is the responsibility of the States as a whole to ensure the freedoms of the Church in Jersey enshrined within the Canons, are preserved and enhanced by this amendment.

 

Resource Implications:  There are no financial or manpower implications

 

Action required:  The Greffier of the States to be requested to arrange for the Projet to be lodged ‘au Greffe’ for consideration by the States at the earliest opportunity.
